\nConvention on the Law of the Sea (UNCLOS). Adopted in 1982, UNCLOS opened a new
\nchapter of global maritime governance, and has greatly helped humanity better
\nunderstand, protect and utilize the sea.\n<\/p>\n
\n\t\u5404\u4f4d\u670b\u53cb\uff0c\n<\/p>\n
\n\tFriends,\n<\/p>\n

\n\tAs an extensive legal instrument on maritime
\naffairs, UNCLOS, together with other international treaties and customary
\ninternational law, constitute the main pillars of the global maritime order in
\nmodern times. A review of its conclusion process, purposes and application gives
\nus three main inspirations in addressing today\u2019s global maritime issues.\n<\/p>\n
\n\t\u4e00\u662f\u5f18\u626c\u591a\u8fb9\u4e3b\u4e49\u3002\u4ece1973\u5e74\u52301982\u5e74\uff0c\u5305\u62ec\u4e2d\u56fd\u5728\u5185\u7684160\u591a\u4e2a\u56fd\u5bb6\uff0c\u5e73\u7b49\u78cb\u5546\u3001\u4e92\u8c05\u4e92\u8ba9\uff0c\u5386\u7ecf9\u5e74\u4e0d\u61c8\u52aa\u529b\uff0c\u6700\u7ec8\u8fbe\u6210\u300a\u516c\u7ea6\u300b\u3002\u300a\u516c\u7ea6\u300b\u7acb\u8db3\u5168\u4eba\u7c7b\u5171\u540c\u5229\u76ca\uff0c\u517c\u987e\u4e0d\u540c\u7c7b\u578b\u56fd\u5bb6\u8bc9\u6c42\uff0c\u8fbe\u6210\u4e00\u63fd\u5b50\u5b89\u6392\uff0c\u83b7\u5f97\u56fd\u9645\u793e\u4f1a\u5e7f\u6cdb\u63a5\u53d7\u3002\u300a\u516c\u7ea6\u300b\u65e2\u8d4b\u4e88\u6cbf\u6d77\u56fd\u5728\u4e13\u5c5e\u7ecf\u6d4e\u533a\u5185\u7684\u4e3b\u6743\u6743\u5229\u548c\u7ba1\u8f96\u6743\uff0c\u4e5f\u4fdd\u969c\u5176\u4ed6\u56fd\u5bb6\u5408\u6cd5\u7684\u822a\u884c\u98de\u8d8a\u7b49\u81ea\u7531\u3002\u300a\u516c\u7ea6\u300b\u4e3a\u548c\u5e73\u89e3\u51b3\u6d77\u6d0b\u4e89\u7aef\u63d0\u4f9b\u591a\u79cd\u9014\u5f84\uff0c\u5145\u5206\u5c0a\u91cd\u4e89\u7aef\u5f53\u4e8b\u56fd\u7684\u81ea\u613f\u9009\u62e9\u3002\u300a\u516c\u7ea6\u300b\u8fd8\u521b\u8bbe\u4e86\u56fd\u9645\u6d77\u5e95\u7ba1\u7406\u5c40\u3001\u5927\u9646\u67b6\u754c\u9650\u59d4\u5458\u4f1a\u3001\u56fd\u9645\u6d77\u6d0b\u6cd5\u6cd5\u5ead\u4e09\u5927\u673a\u6784\uff0c\u4e3a\u8ba8\u8bba\u548c\u89e3\u51b3\u6d77\u6d0b\u95ee\u9898\u63d0\u4f9b\u4e86\u6709\u76ca\u591a\u8fb9\u5e73\u53f0\u3002\u8fd9\u4e9b\u5185\u5bb9\uff0c\u90fd\u662f\u591a\u8fb9\u5916\u4ea4\u7684\u6210\u529f\u5b9e\u8df5\uff0c\u4e5f\u662f\u591a\u8fb9\u4e3b\u4e49\u7684\u91cd\u8981\u6210\u679c\u3002\n<\/p>\n
\n\tFirst, it is important to uphold
\nmultilateralism. UNCLOS was concluded by over 160 countries including China
\nthrough nine years of unremitting efforts of equal-footed consultation and
\nmutual accommodation from 1973 to 1982. It made a set of arrangements to address
\nhumanity\u2019s common interests as well as the concerns of various types of
\ncountries, and thus has been widely accepted by the international community. The
\nConvention entitles coastal States with sovereign rights and jurisdiction in
\ntheir exclusive economic zones while protecting the lawful freedoms of
\nnavigation and overflight of other States in such zones. It provides multiple
\nmeans for the peaceful settlement of maritime disputes, with full respect for
\nStates Parties\u2019 own choices of peaceful means. It also established three major
\nregimes, the International Seabed Authority (ISA), the Commission on the Limits
\nof the Continental Shelf, and the International Tribunal for the Law of the Sea,
\nwhich are useful multilateral platforms for the discussions of and settlement of
\nmaritime issues. All these are a result of successful multilateral diplomacy and
\nimportant outcomes of multilateralism.\n<\/p>\n
\n\t\u4e8c\u662f\u4fc3\u8fdb\u516c\u5e73\u6b63\u4e49\u3002\u4e2d\u56fd\u548c\u5e7f\u5927\u53d1\u5c55\u4e2d\u56fd\u5bb6\u81f4\u529b\u4e8e\u6539\u53d8\u5df2\u843d\u540e\u65f6\u4ee3\u7684\u65e7\u6d77\u6d0b\u89c4\u5219\uff0c\u79ef\u6781\u7ef4\u62a4\u5404\u56fd\u7279\u522b\u662f\u4e2d\u5c0f\u56fd\u5bb6\u7684\u6b63\u5f53\u5408\u6cd5\u6743\u76ca\uff0c\u53d6\u5f97\u79ef\u6781\u6210\u679c\u3002\u300a\u516c\u7ea6\u300b\u5f00\u5b97\u660e\u4e49\u63d0\u51fa\uff0c\u8981\u201c\u5b9e\u73b0\u516c\u6b63\u516c\u5e73\u7684\u56fd\u9645\u7ecf\u6d4e\u79e9\u5e8f\u201d\uff0c\u201c\u7167\u987e\u5230\u5168\u4eba\u7c7b\u7684\u5229\u76ca\u548c\u9700\u8981\u201d\u3002\u300a\u516c\u7ea6\u300b\u786e\u7acb\u4e86\u56fd\u9645\u6d77\u5e95\u7684\u7ba1\u7406\u673a\u5236\u548c\u51b3\u7b56\u7a0b\u5e8f\uff0c\u4ee5\u6cd5\u5f8b\u5f62\u5f0f\u5de9\u56fa\u4e86\u201c\u4eba\u7c7b\u5171\u540c\u7ee7\u627f\u8d22\u4ea7\u201d\u539f\u5219\uff0c\u4e3a\u53d1\u5c55\u4e2d\u56fd\u5bb6\u6709\u6548\u53c2\u4e0e\u56fd\u9645\u6d77\u5e95\u4e8b\u52a1\u63d0\u4f9b\u4e86\u5236\u5ea6\u4fdd\u969c\u3002\u4e8b\u5b9e\u8bc1\u660e\uff0c\u300a\u516c\u7ea6\u300b\u4e3a\u53cd\u5bf9\u6d77\u6d0b\u9738\u6743\uff0c\u4fdd\u62a4\u6d77\u6d0b\u6743\u76ca\uff0c\u4fc3\u8fdb\u6d77\u6d0b\u5408\u4f5c\u53d1\u6325\u4e86\u91cd\u8981\u4f5c\u7528\u3002\n<\/p>\n
\n\tSecond, it is important to promote fairness and
\njustice. China and other developing countries are committed to revising outdated
\nmaritime rules and to defending the legitimate rights and interests of all,
\nespecially medium and small countries, and have made good progress in these
\nefforts. In its Preamble, UNCLOS stresses the imperative to realize \u201ca just and
\nequitable international economic order which takes into account the interests
\nand needs of mankind as a whole\u201d. It established management mechanisms and
\ndecision-making procedures concerning the international seabed. This has
\nconsolidated, by legal means, the principle of the common heritage of mankind,
\nthus providing an institutional framework to ensure the effective participation
\nof developing countries in matters related to the international seabed. Facts
\nhave proved that UNCLOS has been instrumental in opposing maritime hegemony,
\nprotecting maritime interests, and promoting maritime cooperation.\n<\/p>\n
\n\t\u4e09\u662f\u575a\u6301\u5f00\u653e\u8fdb\u6b65\u3002\u300a\u516c\u7ea6\u300b\u6e05\u6670\u8f7d\u660e\uff0c\u201c\u672a\u4e88\u89c4\u5b9a\u7684\u4e8b\u9879\uff0c\u5e94\u7ee7\u7eed\u4ee5\u4e00\u822c\u56fd\u9645\u6cd5\u7684\u89c4\u5219\u548c\u539f\u5219\u4e3a\u51c6\u636e\u201d\u3002\u300a\u516c\u7ea6\u300b\u591a\u6b21\u63d0\u53ca\u201c\u901a\u8fc7\u4e3b\u7ba1\u56fd\u9645\u7ec4\u7ec7\u201d\u91c7\u53d6\u884c\u52a8\uff0c\u8981\u6c42\u201c\u7b26\u5408\u4e00\u822c\u63a5\u53d7\u7684\u56fd\u9645\u89c4\u7ae0\u201d\uff0c\u663e\u793a\u300a\u516c\u7ea6\u300b\u5bf9\u5176\u4ed6\u6d89\u6d77\u7ec4\u7ec7\u548c\u56fd\u9645\u89c4\u5219\u7684\u5c0a\u91cd\u3002\u300a\u516c\u7ea6\u300b\u51fa\u53f0\u540e\u9646\u7eed\u5236\u5b9a\u5173\u4e8e\u56fd\u9645\u6d77\u5e95\u548c\u9c7c\u7c7b\u79cd\u7fa4\u4e24\u4efd\u6267\u884c\u534f\u5b9a\uff0c\u76ee\u524d\u5404\u65b9\u6b63\u5728\u8c08\u5224\u5173\u4e8e\u6d77\u6d0b\u751f\u7269\u591a\u6837\u6027\u7684\u56fd\u9645\u534f\u5b9a\u3002\u8fd9\u4e9b\u90fd\u5145\u5206\u8868\u660e\uff0c\u300a\u516c\u7ea6\u300b\u4e0d\u662f\u81ea\u6211\u5c01\u95ed\u7684\u201c\u7edd\u7f18\u4f53\u201d\uff0c\u800c\u662f\u517c\u6536\u5e76\u84c4\u7684\u201c\u8c03\u8282\u5668\u201d\uff0c\u5e94\u5f53\u59cb\u7ec8\u4e0e\u65f6\u4ff1\u8fdb\uff0c\u4ee5\u66f4\u597d\u5730\u9002\u5e94\u56fd\u9645\u6d77\u6d0b\u5b9e\u8df5\u3002\n<\/p>\n
\n\tThird, it is important to stay open-minded and
\nmove forward. UNCLOS affirms that \u201cmatters not regulated by this convention
\ncontinue to be governed by the rules and principles of general international
\nlaw\u201d. It also mentions several times that actions should be taken \u201cthrough
\ncompetent international organizations\u201d and in compliance with \u201cgenerally
\naccepted international regulations\u201d. This shows that UNCLOS respects other
\nsea-related organizations and international rules. Following the adoption of the
\nConvention, two agreements, one on the international seabed and the other on
\nfish stocks, were concluded. Negotiations on an international agreement on
\nmaritime biodiversity are now well underway. All this shows that UNCLOS is not
\nisolated or insulated, but rather inclusive and adjustable. It should keep pace
\nwith the times to better adapt to international maritime practices.\n<\/p>\n

\n\tAs a major developing maritime country, China
\nseeks to balance its legitimate rights and interests with the overall interests
\nof the international community, and always stands together with other developing
\ncountries. We have participated in the whole process of UNCLOS negotiations, and
\nwas among the first countries to sign the Convention. China always honors the
\nspirit of UNCLOS, strictly fulfills its obligations, and fully supports the work
\nof the three major institutions under the Convention. It actively carries out
\ninternational maritime cooperation, and does its best to help other developing
\ncountries with their maritime capacity-building. China firmly defends the
\nintegrity and authority of UNCLOS, and opposes attempts at abusing the dispute
\nsettlement procedures of the Convention. China always believes that maritime
\ndisputes should be settled by the parties directly concerned through friendly
\nconsultation on the basis of respecting historical facts and international laws
\nincluding UNCLOS.\n<\/p>\n

\nonce-in-a-century changes that are evolving more rapidly, and the international
\nmaritime order is undergoing profound adjustments. At this new historical
\nstarting point, we should safeguard firmly the UN-centered international system
\nand the international order underpinned by international law. We should continue
\nto embrace the spirit of multilateralism in UNCLOS, promote the development of
\ninternational maritime laws including the Convention, and build an equitable and
\njust international maritime order, as part of our collective efforts to usher in
\na new journey of maritime governance.\n<\/p>\n

\n\tWe need to act as a community with a shared
\nfuture to promote sustainable development of the sea. We need to pursue the
\npurpose of the Convention to \u201cpromote the economic and social advancement of all
\npeoples of the world\u201d, and act on the Global Development Initiative proposed by
\nPresident Xi Jinping. We need to deepen practical maritime cooperation, develop
\nblue partnerships, build a high-quality 21st Century Maritime Silk Road, and
\nfulfill the UN sustainable development goals. We need to tap into the
\ndevelopment potential of the sea and turn it into an enduring driving force for
\nsustainable development of all countries.\n<\/p>\n

\nto maintain \u201cpeace, justice and progress for all peoples of the world\u201d, take
\ncoordinated efforts to safeguard both traditional and non-traditional maritime
\nsecurity issues, always settle maritime disputes through peaceful means, and
\njointly tackle challenges such as piracy and armed robbery against ships. We
\nshould uphold \u201cfreedom of navigation\u201d and oppose \u201cfreedom of willfulness\u201d. We
\nshould advocate dialogue and consultation, and say no to sabre-rattling. All
\nparties must bear in mind that humanity is an indivisible security community,
\nand all should work together to safeguard maritime peace and tranquility of the
\nworld.\n<\/p>\n

\nenvironment\u201d, act on the philosophy of green development, fulfill environmental
\nprotection obligations under the Convention, and advance global cooperation to
\nprotect the marine environment. We should prioritize science and technology,
\ntake seriously the impact of land activities and climate change on marine
\nenvironment, and do more to address both the symptoms and root causes. We should
\nstrike a balance between preservation and reasonable utilization, and work
\ntogether to leave clean oceans and blue sky for our future generations.\n<\/p>\n

\napplied in its entirety, accurately, and in good faith. Any attempt to use
\nUNCLOS as a tool to suppress or smear other countries must be rejected. We need
\nto improve the dispute settlement mechanisms, respect the voluntary choice of
\nthe State Parties concerned, and oppose inappropriate expansion or abuse of
\npower by judicial bodies. The UN, the ISA, and the International Maritime
\nOrganization should work in coordination to study emerging maritime issues, and
\nmake and improve equitable and reasonable international maritime rules that can
\nstand the test of history and reality.\n<\/p>\n
