\nArticle 1 This Law is enacted, in accordance with the Constitution of the People\u2019s Republic of China, the Basic Law of the Hong Kong Special Administrative Region of the People\u2019s Republic of China, and the Decision of the National People\u2019s Congress on Establishing and Improving the Legal System and Enforcement Mechanisms for Safeguarding National Security in the Hong Kong Special Administrative Region, for the purpose of:<\/span>
\nensuring the resolute, full and faithful implementation of the policy of One Country, Two Systems under which the people of Hong Kong administer Hong Kong with a high degree of autonomy;<\/span>
\nsafeguarding national security; <\/span>
\npreventing, suppressing and imposing punishment for the offences of secession, subversion, organisation and perpetration of terrorist activities, and collusion with a foreign country or with external elements to endanger national security in relation to the Hong Kong Special Administrative Region;<\/span>
\nmaintaining prosperity and stability of the Hong Kong Special Administrative Region; and <\/span>
\nprotecting the lawful rights and interests of the residents of the Hong Kong Special Administrative Region.<\/span>
\n\u7b2c\u4e8c\u6761\u3000\u5173\u4e8e\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6cd5\u5f8b\u5730\u4f4d\u7684\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\u7b2c\u4e00\u6761\u548c\u7b2c\u5341\u4e8c\u6761\u89c4\u5b9a\u662f\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\u7684\u6839\u672c\u6027\u6761\u6b3e\u3002\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4efb\u4f55\u673a\u6784\u3001\u7ec4\u7ec7\u548c\u4e2a\u4eba\u884c\u4f7f\u6743\u5229\u548c\u81ea\u7531\uff0c\u4e0d\u5f97\u8fdd\u80cc\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\u7b2c\u4e00\u6761\u548c\u7b2c\u5341\u4e8c\u6761\u7684\u89c4\u5b9a\u3002<\/span>
\nArticle 2 The provisions in Articles 1 and 12 of the Basic Law of the Hong Kong Special Administrative Region on the legal status of the Hong Kong Special Administrative Region are the fundamental provisions in the Basic Law. No institution, organisation or individual in the Region shall contravene these provisions in exercising their rights and freedoms.<\/span>
\n\u7b2c\u4e09\u6761\u3000\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u5bf9\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6709\u5173\u7684\u56fd\u5bb6\u5b89\u5168\u4e8b\u52a1\u8d1f\u6709\u6839\u672c\u8d23\u4efb\u3002<\/span>
\nArticle 3 The Central People\u2019s Government has an overarching responsibility for national security affairs relating to the Hong Kong Special Administrative Region.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u8d1f\u6709\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u5baa\u5236\u8d23\u4efb\uff0c\u5e94\u5f53\u5c65\u884c\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u804c\u8d23\u3002<\/span>
\nIt is the duty of the Hong Kong Special Administrative Region under the Constitution to safeguard national security and the Region shall perform the duty accordingly.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u884c\u653f\u673a\u5173\u3001\u7acb\u6cd5\u673a\u5173\u3001\u53f8\u6cd5\u673a\u5173\u5e94\u5f53\u4f9d\u636e\u672c\u6cd5\u548c\u5176\u4ed6\u6709\u5173\u6cd5\u5f8b\u89c4\u5b9a\u6709\u6548\u9632\u8303\u3001\u5236\u6b62\u548c\u60e9\u6cbb\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u7684\u884c\u4e3a\u548c\u6d3b\u52a8\u3002<\/span>
\nThe executive authorities, legislature and judiciary of the Region shall effectively prevent, suppress and impose punishment for any act or activity endangering national security in accordance with this Law and other relevant laws.<\/span>
\n\u7b2c\u56db\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u5e94\u5f53\u5c0a\u91cd\u548c\u4fdd\u969c\u4eba\u6743\uff0c\u4f9d\u6cd5\u4fdd\u62a4\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5c45\u6c11\u6839\u636e\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\u548c\u300a\u516c\u6c11\u6743\u5229\u548c\u653f\u6cbb\u6743\u5229\u56fd\u9645\u516c\u7ea6\u300b\u3001\u300a\u7ecf\u6d4e\u3001\u793e\u4f1a\u4e0e\u6587\u5316\u6743\u5229\u7684\u56fd\u9645\u516c\u7ea6\u300b\u9002\u7528\u4e8e\u9999\u6e2f\u7684\u6709\u5173\u89c4\u5b9a\u4eab\u6709\u7684\u5305\u62ec\u8a00\u8bba\u3001\u65b0\u95fb\u3001\u51fa\u7248\u7684\u81ea\u7531\uff0c\u7ed3\u793e\u3001\u96c6\u4f1a\u3001\u6e38\u884c\u3001\u793a\u5a01\u7684\u81ea\u7531\u5728\u5185\u7684\u6743\u5229\u548c\u81ea\u7531\u3002<\/span>
\nArticle 4 Human rights shall be respected and protected in safeguarding national security in the Hong Kong Special Administrative Region. The rights and freedoms, including the freedoms of speech, of the press, of publication, of association, of assembly, of procession and of demonstration, which the residents of the Region enjoy under the Basic Law of the Hong Kong Special Administrative Region and the provisions of the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights as applied to Hong Kong, shall be protected in accordance with the law.<\/span>
\n\u7b2c\u4e94\u6761\u3000\u9632\u8303\u3001\u5236\u6b62\u548c\u60e9\u6cbb\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\uff0c\u5e94\u5f53\u575a\u6301\u6cd5\u6cbb\u539f\u5219\u3002\u6cd5\u5f8b\u89c4\u5b9a\u4e3a\u72af\u7f6a\u884c\u4e3a\u7684\uff0c\u4f9d\u7167\u6cd5\u5f8b\u5b9a\u7f6a\u5904\u5211\uff1b\u6cd5\u5f8b\u6ca1\u6709\u89c4\u5b9a\u4e3a\u72af\u7f6a\u884c\u4e3a\u7684\uff0c\u4e0d\u5f97\u5b9a\u7f6a\u5904\u5211\u3002<\/span>
\nArticle 5 The principle of the rule of law shall be adhered to in preventing, suppressing, and imposing punishment for offences endangering national security. A person who commits an act which constitutes an offence under the law shall be convicted and punished in accordance with the law. No one shall be convicted and punished for an act which does not constitute an offence under the law.<\/span>
\n\u4efb\u4f55\u4eba\u672a\u7ecf\u53f8\u6cd5\u673a\u5173\u5224\u7f6a\u4e4b\u524d\u5747\u5047\u5b9a\u65e0\u7f6a\u3002\u4fdd\u969c\u72af\u7f6a\u5acc\u7591\u4eba\u3001\u88ab\u544a\u4eba\u548c\u5176\u4ed6\u8bc9\u8bbc\u53c2\u4e0e\u4eba\u4f9d\u6cd5\u4eab\u6709\u7684\u8fa9\u62a4\u6743\u548c\u5176\u4ed6\u8bc9\u8bbc\u6743\u5229\u3002\u4efb\u4f55\u4eba\u5df2\u7ecf\u53f8\u6cd5\u7a0b\u5e8f\u88ab\u6700\u7ec8\u786e\u5b9a\u6709\u7f6a\u6216\u8005\u5ba3\u544a\u65e0\u7f6a\u7684\uff0c\u4e0d\u5f97\u5c31\u540c\u4e00\u884c\u4e3a\u518d\u4e88\u5ba1\u5224\u6216\u8005\u60e9\u7f5a\u3002<\/span>
\nA person is presumed innocent until convicted by a judicial body. The right to defend himself or herself and other rights in judicial proceedings that a criminal suspect, defendant, and other parties in judicial proceedings are entitled to under the law shall be protected. No one shall be liable to be tried or punished again for an offence for which he or she has already been finally convicted or acquitted in judicial proceedings.<\/span>
\n\u7b2c\u516d\u6761\u3000\u7ef4\u62a4\u56fd\u5bb6\u4e3b\u6743\u3001\u7edf\u4e00\u548c\u9886\u571f\u5b8c\u6574\u662f\u5305\u62ec\u9999\u6e2f\u540c\u80de\u5728\u5185\u7684\u5168\u4e2d\u56fd\u4eba\u6c11\u7684\u5171\u540c\u4e49\u52a1\u3002<\/span>
\nArticle 6 It is the common responsibility of all the people of China, including the people of Hong Kong, to safeguard the sovereignty, unification and territorial integrity of the People\u2019s Republic of China.<\/span>
\n\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7684\u4efb\u4f55\u673a\u6784\u3001\u7ec4\u7ec7\u548c\u4e2a\u4eba\u90fd\u5e94\u5f53\u9075\u5b88\u672c\u6cd5\u548c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6709\u5173\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u5176\u4ed6\u6cd5\u5f8b\uff0c\u4e0d\u5f97\u4ece\u4e8b\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u7684\u884c\u4e3a\u548c\u6d3b\u52a8\u3002<\/span>
\nAny institution, organisation or individual in the Hong Kong Special Administrative Region shall abide by this Law and the laws of the Region in relation to the safeguarding of national security, and shall not engage in any act or activity which endangers national security.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5c45\u6c11\u5728\u53c2\u9009\u6216\u8005\u5c31\u4efb\u516c\u804c\u65f6\u5e94\u5f53\u4f9d\u6cd5\u7b7e\u7f72\u6587\u4ef6\u786e\u8ba4\u6216\u8005\u5ba3\u8a93\u62e5\u62a4\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\uff0c\u6548\u5fe0\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u3002<\/span>
\nA resident of the Region who stands for election or assumes public office shall confirm in writing or take an oath to uphold the Basic Law of the Hong Kong Special Administrative Region of the People\u2019s Republic of China and swear allegiance to the Hong Kong Special Administrative Region of the People\u2019s Republic of China in accordance with the law. <\/span>

\n\u7b2c\u4e03\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5e94\u5f53\u5c3d\u65e9\u5b8c\u6210\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\u89c4\u5b9a\u7684\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7acb\u6cd5\uff0c\u5b8c\u5584\u76f8\u5173\u6cd5\u5f8b\u3002<\/span>
\nArticle 7 The Hong Kong Special Administrative Region shall complete, as early as possible, legislation for safeguarding national security as stipulated in the Basic Law of the Hong Kong Special Administrative Region and shall refine relevant laws.<\/span>
\n\u7b2c\u516b\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6267\u6cd5\u3001\u53f8\u6cd5\u673a\u5173\u5e94\u5f53\u5207\u5b9e\u6267\u884c\u672c\u6cd5\u548c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u73b0\u884c\u6cd5\u5f8b\u6709\u5173\u9632\u8303\u3001\u5236\u6b62\u548c\u60e9\u6cbb\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u884c\u4e3a\u548c\u6d3b\u52a8\u7684\u89c4\u5b9a\uff0c\u6709\u6548\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u3002<\/span>
\nArticle 8 In order to safeguard national security effectively, the law enforcement and judicial authorities of the Hong Kong Special Administrative Region shall fully enforce this Law and the laws in force in the Region concerning the prevention of, suppression of, and imposition of punishment for acts and activities endangering national security.<\/span>
\n\u7b2c\u4e5d\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5e94\u5f53\u52a0\u5f3a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u548c\u9632\u8303\u6050\u6016\u6d3b\u52a8\u7684\u5de5\u4f5c\u3002\u5bf9\u5b66\u6821\u3001\u793e\u4f1a\u56e2\u4f53\u3001\u5a92\u4f53\u3001\u7f51\u7edc\u7b49\u6d89\u53ca\u56fd\u5bb6\u5b89\u5168\u7684\u4e8b\u5b9c\uff0c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u5e94\u5f53\u91c7\u53d6\u5fc5\u8981\u63aa\u65bd\uff0c\u52a0\u5f3a\u5ba3\u4f20\u3001\u6307\u5bfc\u3001\u76d1\u7763\u548c\u7ba1\u7406\u3002<\/span>
\nArticle 9 The Hong Kong Special Administrative Region shall strengthen its work on safeguarding national security and prevention of terrorist activities. The Government of the Hong Kong Special Administrative Region shall take necessary measures to strengthen public communication, guidance, supervision and regulation over matters concerning national security, including those relating to schools, universities, social organisations, the media, and the internet.<\/span>
\n\u7b2c\u5341\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5e94\u5f53\u901a\u8fc7\u5b66\u6821\u3001\u793e\u4f1a\u56e2\u4f53\u3001\u5a92\u4f53\u3001\u7f51\u7edc\u7b49\u5f00\u5c55\u56fd\u5bb6\u5b89\u5168\u6559\u80b2\uff0c\u63d0\u9ad8\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5c45\u6c11\u7684\u56fd\u5bb6\u5b89\u5168\u610f\u8bc6\u548c\u5b88\u6cd5\u610f\u8bc6\u3002<\/span>
\nArticle 10 The Hong Kong Special Administrative Region shall promote national security education in schools and universities and through social organisations, the media, the internet and other means to raise the awareness of Hong Kong residents of national security and of the obligation to abide by the law.<\/span>

\nArticle 11 The Chief Executive of the Hong Kong Special Administrative Region shall be accountable to the Central People\u2019s Government for affairs relating to safeguarding national security in the Hong Kong Special Administrative Region and shall submit an annual report on the performance of duties of the Region in safeguarding national security.<\/span>
\n\u5982\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u63d0\u51fa\u8981\u6c42\uff0c\u884c\u653f\u957f\u5b98\u5e94\u5f53\u5c31\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7279\u5b9a\u4e8b\u9879\u53ca\u65f6\u63d0\u4ea4\u62a5\u544a\u3002<\/span>
\nThe Chief Executive shall, at the request of the Central People\u2019s Government, submit in a timely manner a report on specific matters relating to safeguarding national security.<\/span>

\nPart 2 Government Bodies<\/span>
\n\u7b2c\u5341\u4e8c\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u8bbe\u7acb\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\uff0c\u8d1f\u8d23\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u4e8b\u52a1\uff0c\u627f\u62c5\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u4e3b\u8981\u8d23\u4efb\uff0c\u5e76\u63a5\u53d7\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u7684\u76d1\u7763\u548c\u95ee\u8d23\u3002<\/span>
\nArticle 12 The Hong Kong Special Administrative Region shall establish the Committee for Safeguarding National Security. The Committee shall be responsible for affairs relating to and assume primary responsibility for safeguarding national security in the Region. It shall be under the supervision of and accountable to the Central People\u2019s Government.<\/span>
\n\u7b2c\u5341\u4e09\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u7531\u884c\u653f\u957f\u5b98\u62c5\u4efb\u4e3b\u5e2d\uff0c\u6210\u5458\u5305\u62ec\u653f\u52a1\u53f8\u957f\u3001\u8d22\u653f\u53f8\u957f\u3001\u5f8b\u653f\u53f8\u957f\u3001\u4fdd\u5b89\u5c40\u5c40\u957f\u3001\u8b66\u52a1\u5904\u5904\u957f\u3001\u672c\u6cd5\u7b2c\u5341\u516d\u6761\u89c4\u5b9a\u7684\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u7684\u8d1f\u8d23\u4eba\u3001\u5165\u5883\u4e8b\u52a1\u5904\u5904\u957f\u3001\u6d77\u5173\u5173\u957f\u548c\u884c\u653f\u957f\u5b98\u529e\u516c\u5ba4\u4e3b\u4efb\u3002<\/span>
\nArticle 13 The Chief Executive shall be the chairperson of the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region. The other members of the Committee shall be the Chief Secretary for Administration, the Financial Secretary, the Secretary for Justice, the Secretary for Security, the Commissioner of Police, the head of the department for safeguarding national security of the Hong Kong Police Force established under Article 16 of this Law, the Director of Immigration, the Commissioner of Customs and Excise, and the Director of the Chief Executive\u2019s Office.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u4e0b\u8bbe\u79d8\u4e66\u5904\uff0c\u7531\u79d8\u4e66\u957f\u9886\u5bfc\u3002\u79d8\u4e66\u957f\u7531\u884c\u653f\u957f\u5b98\u63d0\u540d\uff0c\u62a5\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u4efb\u547d\u3002<\/span>
\nA secretariat headed by a Secretary-General shall be established under the Committee. The Secretary-General shall be appointed by the Central People\u2019s Government upon nomination by the Chief Executive.<\/span>
\n\u7b2c\u5341\u56db\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u7684\u804c\u8d23\u4e3a\uff1a<\/span>
\nArticle 14 The duties and functions of the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region shall be:<\/span>
\n\uff08\u4e00\uff09\u5206\u6790\u7814\u5224\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u5f62\u52bf\uff0c\u89c4\u5212\u6709\u5173\u5de5\u4f5c\uff0c\u5236\u5b9a\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u653f\u7b56\uff1b<\/span>
\n(1) analysing and assessing developments in relation to safeguarding national security in the Hong Kong Special Administrative Region, making work plans, and formulating policies for safeguarding national security in the Region;<\/span>
\n\uff08\u4e8c\uff09\u63a8\u8fdb\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u6cd5\u5f8b\u5236\u5ea6\u548c\u6267\u884c\u673a\u5236\u5efa\u8bbe\uff1b<\/span>
\n(2) advancing the development of the legal system and enforcement mechanisms of the Region for safeguarding national security; and<\/span>
\n\uff08\u4e09\uff09\u534f\u8c03\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u91cd\u70b9\u5de5\u4f5c\u548c\u91cd\u5927\u884c\u52a8\u3002<\/span>
\n(3) coordinating major work and significant operations for safeguarding national security in the Region.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u7684\u5de5\u4f5c\u4e0d\u53d7\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4efb\u4f55\u5176\u4ed6\u673a\u6784\u3001\u7ec4\u7ec7\u548c\u4e2a\u4eba\u7684\u5e72\u6d89\uff0c\u5de5\u4f5c\u4fe1\u606f\u4e0d\u4e88\u516c\u5f00\u3002\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u4f5c\u51fa\u7684\u51b3\u5b9a\u4e0d\u53d7\u53f8\u6cd5\u590d\u6838\u3002<\/span>
\nNo institution, organisation or individual in the Region shall interfere with the work of the Committee. Information relating to the work of the Committee shall not be subject to disclosure. Decisions made by the Committee shall not be amenable to judicial review.<\/span>
\n\u7b2c\u5341\u4e94\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u8bbe\u7acb\u56fd\u5bb6\u5b89\u5168\u4e8b\u52a1\u987e\u95ee\uff0c\u7531\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u6307\u6d3e\uff0c\u5c31\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u5c65\u884c\u804c\u8d23\u76f8\u5173\u4e8b\u52a1\u63d0\u4f9b\u610f\u89c1\u3002\u56fd\u5bb6\u5b89\u5168\u4e8b\u52a1\u987e\u95ee\u5217\u5e2d\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u4f1a\u8bae\u3002<\/span>
\nArticle 15 The Committee for Safeguarding National Security of the Hong Kong Special Administrative Region shall have a National Security Adviser, who shall be designated by the Central People\u2019s Government and provide advice on matters relating to the duties and functions of the Committee. The National Security Adviser shall sit in on meetings of the Committee.<\/span>
\n\u7b2c\u5341\u516d\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u8b66\u52a1\u5904\u8bbe\u7acb\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u90e8\u95e8\uff0c\u914d\u5907\u6267\u6cd5\u529b\u91cf\u3002<\/span>
\nArticle 16 The Police Force of the Hong Kong Special Administrative Region shall establish a department for safeguarding national security with law enforcement capacity.<\/span>
\n\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u8d1f\u8d23\u4eba\u7531\u884c\u653f\u957f\u5b98\u4efb\u547d\uff0c\u884c\u653f\u957f\u5b98\u4efb\u547d\u524d\u987b\u4e66\u9762\u5f81\u6c42\u672c\u6cd5\u7b2c\u56db\u5341\u516b\u6761\u89c4\u5b9a\u7684\u673a\u6784\u7684\u610f\u89c1\u3002\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u8d1f\u8d23\u4eba\u5728\u5c31\u804c\u65f6\u5e94\u5f53\u5ba3\u8a93\u62e5\u62a4\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\uff0c\u6548\u5fe0\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\uff0c\u9075\u5b88\u6cd5\u5f8b\uff0c\u4fdd\u5b88\u79d8\u5bc6\u3002<\/span>
\nThe head of the department for safeguarding national security of the Hong Kong Police Force shall be appointed by the Chief Executive. The Chief Executive shall seek in writing the opinion of the Office established under Article 48 of this Law before making the appointment. When assuming office, the head of the department for safeguarding national security of the Hong Kong Police Force shall swear to uphold the Basic Law of the Hong Kong Special Administrative Region of the People\u2019s Republic of China, swear allegiance to the Hong Kong Special Administrative Region of the People\u2019s Republic of China, and swear to abide by the law and to observe the obligation of secrecy.<\/span>
\n\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u53ef\u4ee5\u4ece\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4ee5\u5916\u8058\u8bf7\u5408\u683c\u7684\u4e13\u95e8\u4eba\u5458\u548c\u6280\u672f\u4eba\u5458\uff0c\u534f\u52a9\u6267\u884c\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u76f8\u5173\u4efb\u52a1\u3002<\/span>
\nThe department for safeguarding national security of the Hong Kong Police Force may recruit qualified professionals and technical personnel from outside the Hong Kong Special Administrative Region to provide assistance in the performance of duties for safeguarding national security.<\/span>
\n\u7b2c\u5341\u4e03\u6761\u3000\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u7684\u804c\u8d23\u4e3a\uff1a<\/span>
\nArticle 17 The duties and functions of the department for safeguarding national security of the Hong Kong Police Force shall be:<\/span>
\n\uff08\u4e00\uff09\u6536\u96c6\u5206\u6790\u6d89\u53ca\u56fd\u5bb6\u5b89\u5168\u7684\u60c5\u62a5\u4fe1\u606f\uff1b<\/span>
\n(1) collecting and analysing intelligence and information concerning national security;<\/span>
\n\uff08\u4e8c\uff09\u90e8\u7f72\u3001\u534f\u8c03\u3001\u63a8\u8fdb\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u63aa\u65bd\u548c\u884c\u52a8\uff1b<\/span>
\n(2) planning, coordinating and enforcing measures and operations for safeguarding national security;<\/span>
\n\uff08\u4e09\uff09\u8c03\u67e5\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\uff1b<\/span>
\n(3) investigating offences endangering national security;<\/span>
\n\uff08\u56db\uff09\u8fdb\u884c\u53cd\u5e72\u9884\u8c03\u67e5\u548c\u5f00\u5c55\u56fd\u5bb6\u5b89\u5168\u5ba1\u67e5\uff1b<\/span>
\n(4) conducting counter-interference investigation and national security review;<\/span>
\n\uff08\u4e94\uff09\u627f\u529e\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u4ea4\u529e\u7684\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u5de5\u4f5c\uff1b<\/span>
\n(5) carrying out tasks of safeguarding national security assigned by the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region; and<\/span>
\n\uff08\u516d\uff09\u6267\u884c\u672c\u6cd5\u6240\u9700\u7684\u5176\u4ed6\u804c\u8d23\u3002<\/span>
\n(6) performing other duties and functions necessary for the enforcement of this Law.<\/span>
\n\u7b2c\u5341\u516b\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5f8b\u653f\u53f8\u8bbe\u7acb\u4e13\u95e8\u7684\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u68c0\u63a7\u90e8\u95e8\uff0c\u8d1f\u8d23\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u7684\u68c0\u63a7\u5de5\u4f5c\u548c\u5176\u4ed6\u76f8\u5173\u6cd5\u5f8b\u4e8b\u52a1\u3002\u8be5\u90e8\u95e8\u68c0\u63a7\u5b98\u7531\u5f8b\u653f\u53f8\u957f\u5f81\u5f97\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u540c\u610f\u540e\u4efb\u547d\u3002<\/span>
\nArticle 18 The Department of Justice of the Hong Kong Special Administrative Region shall establish a specialised prosecution division responsible for the prosecution of offences endangering national security and other related legal work. The prosecutors of this division shall be appointed by the Secretary for Justice after obtaining the consent of the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region.<\/span>
\n\u5f8b\u653f\u53f8\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u68c0\u63a7\u90e8\u95e8\u8d1f\u8d23\u4eba\u7531\u884c\u653f\u957f\u5b98\u4efb\u547d\uff0c\u884c\u653f\u957f\u5b98\u4efb\u547d\u524d\u987b\u4e66\u9762\u5f81\u6c42\u672c\u6cd5\u7b2c\u56db\u5341\u516b\u6761\u89c4\u5b9a\u7684\u673a\u6784\u7684\u610f\u89c1\u3002\u5f8b\u653f\u53f8\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u68c0\u63a7\u90e8\u95e8\u8d1f\u8d23\u4eba\u5728\u5c31\u804c\u65f6\u5e94\u5f53\u5ba3\u8a93\u62e5\u62a4\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\uff0c\u6548\u5fe0\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\uff0c\u9075\u5b88\u6cd5\u5f8b\uff0c\u4fdd\u5b88\u79d8\u5bc6\u3002<\/span>

\n\u7b2c\u5341\u4e5d\u6761\u3000\u7ecf\u884c\u653f\u957f\u5b98\u6279\u51c6\uff0c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u8d22\u653f\u53f8\u957f\u5e94\u5f53\u4ece\u653f\u5e9c\u4e00\u822c\u6536\u5165\u4e2d\u62e8\u51fa\u4e13\u95e8\u6b3e\u9879\u652f\u4ed8\u5173\u4e8e\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u5f00\u652f\u5e76\u6838\u51c6\u6240\u6d89\u53ca\u7684\u4eba\u5458\u7f16\u5236\uff0c\u4e0d\u53d7\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u73b0\u884c\u6709\u5173\u6cd5\u5f8b\u89c4\u5b9a\u7684\u9650\u5236\u3002\u8d22\u653f\u53f8\u957f\u987b\u6bcf\u5e74\u5c31\u8be5\u6b3e\u9879\u7684\u63a7\u5236\u548c\u7ba1\u7406\u5411\u7acb\u6cd5\u4f1a\u63d0\u4ea4\u62a5\u544a\u3002<\/span>
\nArticle 19 The Financial Secretary of the Hong Kong Special Administrative Region shall, upon approval of the Chief Executive, appropriate from the general revenue a special fund to meet the expenditure for safeguarding national security and approve the establishment of relevant posts, which are not subject to any restrictions in the relevant provisions of the laws in force in the Region. The Financial Secretary shall submit an annual report on the control and management of the fund for this purpose to the Legislative Council of the Hong Kong Special Administrative Region.<\/span>

\n\u7b2c\u4e8c\u5341\u6761\u3000\u4efb\u4f55\u4eba\u7ec4\u7ec7\u3001\u7b56\u5212\u3001\u5b9e\u65bd\u6216\u8005\u53c2\u4e0e\u5b9e\u65bd\u4ee5\u4e0b\u65e8\u5728\u5206\u88c2\u56fd\u5bb6\u3001\u7834\u574f\u56fd\u5bb6\u7edf\u4e00\u884c\u4e3a\u4e4b\u4e00\u7684\uff0c\u4e0d\u8bba\u662f\u5426\u4f7f\u7528\u6b66\u529b\u6216\u8005\u4ee5\u6b66\u529b\u76f8\u5a01\u80c1\uff0c\u5373\u5c5e\u72af\u7f6a\uff1a<\/span>
\nArticle 20 A person who organises, plans, commits or participates in any of the following acts, whether or not by force or threat of force, with a view to committing secession or undermining national unification shall be guilty of an offence:<\/span>

\n(1) separating the Hong Kong Special Administrative Region or any other part of the People\u2019s Republic of China from the People\u2019s Republic of China;<\/span>
\n\uff08\u4e8c\uff09\u975e\u6cd5\u6539\u53d8\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6216\u8005\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u5176\u4ed6\u4efb\u4f55\u90e8\u5206\u7684\u6cd5\u5f8b\u5730\u4f4d\uff1b<\/span>
\n(2) altering by unlawful means the legal status of the Hong Kong Special Administrative Region or of any other part of the People\u2019s Republic of China; or<\/span>
\n\uff08\u4e09\uff09\u5c06\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6216\u8005\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u5176\u4ed6\u4efb\u4f55\u90e8\u5206\u8f6c\u5f52\u5916\u56fd\u7edf\u6cbb\u3002<\/span>
\n(3) surrendering the Hong Kong Special Administrative Region or any other part of the People\u2019s Republic of China to a foreign country.<\/span>

\nA person who is a principal offender or a person who commits an offence of a grave nature shall be sentenced to life imprisonment or fixed-term imprisonment of not less than ten years; a person who actively participates in the offence shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; and other participants shall be sentenced to fixed-term imprisonment of not more than three years, short-term detention or restriction.<\/span>

\nArticle 21 A person who incites, assists in, abets or provides pecuniary or other financial assistance or property for the commission by other persons of the offence under Article 20 of this Law shall be guilty of an offence. If the circumstances of the offence committed by a person are of a serious nature, the person shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years; if the circumstances of the offence committed by a person are of a minor nature, the person shall be sentenced to fixed-term imprisonment of not more than five years, short-term detention or restriction.<\/span>

\n\u7b2c\u4e8c\u5341\u4e8c\u6761\u3000\u4efb\u4f55\u4eba\u7ec4\u7ec7\u3001\u7b56\u5212\u3001\u5b9e\u65bd\u6216\u8005\u53c2\u4e0e\u5b9e\u65bd\u4ee5\u4e0b\u4ee5\u6b66\u529b\u3001\u5a01\u80c1\u4f7f\u7528\u6b66\u529b\u6216\u8005\u5176\u4ed6\u975e\u6cd5\u624b\u6bb5\u65e8\u5728\u98a0\u8986\u56fd\u5bb6\u653f\u6743\u884c\u4e3a\u4e4b\u4e00\u7684\uff0c\u5373\u5c5e\u72af\u7f6a\uff1a<\/span>
\nArticle 22 A person who organises, plans, commits or participates in any of the following acts by force or threat of force or other unlawful means with a view to subverting the State power shall be guilty of an offence:<\/span>
\n\uff08\u4e00\uff09\u63a8\u7ffb\u3001\u7834\u574f\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u5baa\u6cd5\u6240\u786e\u7acb\u7684\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u6839\u672c\u5236\u5ea6\uff1b<\/span>
\n(1) overthrowing or undermining the basic system of the People\u2019s Republic of China established by the Constitution of the People\u2019s Republic of China;<\/span>

\n(2) overthrowing the body of central power of the People\u2019s Republic of China or the body of power of the Hong Kong Special Administrative Region;<\/span>
\n\uff08\u4e09\uff09\u4e25\u91cd\u5e72\u6270\u3001\u963b\u6320\u3001\u7834\u574f\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u4e2d\u592e\u653f\u6743\u673a\u5173\u6216\u8005\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u6743\u673a\u5173\u4f9d\u6cd5\u5c65\u884c\u804c\u80fd\uff1b<\/span>
\n(3) seriously interfering in, disrupting, or undermining the performance of duties and functions in accordance with the law by the body of central power of the People\u2019s Republic of China or the body of power of the Hong Kong Special Administrative Region; or<\/span>
\n\uff08\u56db\uff09\u653b\u51fb\u3001\u7834\u574f\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u6743\u673a\u5173\u5c65\u804c\u573a\u6240\u53ca\u5176\u8bbe\u65bd\uff0c\u81f4\u4f7f\u5176\u65e0\u6cd5\u6b63\u5e38\u5c65\u884c\u804c\u80fd\u3002<\/span>
\n(4) attacking or damaging the premises and facilities used by the body of power of the Hong Kong Special Administrative Region to perform its duties and functions, rendering it incapable of performing its normal duties and functions.<\/span>
\n\u72af\u524d\u6b3e\u7f6a\uff0c\u5bf9\u9996\u8981\u5206\u5b50\u6216\u8005\u7f6a\u884c\u91cd\u5927\u7684\uff0c\u5904\u65e0\u671f\u5f92\u5211\u6216\u8005\u5341\u5e74\u4ee5\u4e0a\u6709\u671f\u5f92\u5211\uff1b\u5bf9\u79ef\u6781\u53c2\u52a0\u7684\uff0c\u5904\u4e09\u5e74\u4ee5\u4e0a\u5341\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\uff1b\u5bf9\u5176\u4ed6\u53c2\u52a0\u7684\uff0c\u5904\u4e09\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\u3001\u62d8\u5f79\u6216\u8005\u7ba1\u5236\u3002<\/span>

\nPart 3 Terrorist Activities<\/span>
\n\u7b2c\u4e8c\u5341\u56db\u6761\u3000\u4e3a\u80c1\u8feb\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u3001\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u6216\u8005\u56fd\u9645\u7ec4\u7ec7\u6216\u8005\u5a01\u5413\u516c\u4f17\u4ee5\u56fe\u5b9e\u73b0\u653f\u6cbb\u4e3b\u5f20\uff0c\u7ec4\u7ec7\u3001\u7b56\u5212\u3001\u5b9e\u65bd\u3001\u53c2\u4e0e\u5b9e\u65bd\u6216\u8005\u5a01\u80c1\u5b9e\u65bd\u4ee5\u4e0b\u9020\u6210\u6216\u8005\u610f\u56fe\u9020\u6210\u4e25\u91cd\u793e\u4f1a\u5371\u5bb3\u7684\u6050\u6016\u6d3b\u52a8\u4e4b\u4e00\u7684\uff0c\u5373\u5c5e\u72af\u7f6a\uff1a<\/span>
\nArticle 24 A person who organises, plans, commits, participates in or threatens to commit any of the following terrorist activities causing or intended to cause grave harm to the society with a view to coercing the Central People\u2019s Government, the Government of the Hong Kong Special Administrative Region or an international organisation or intimidating the public in order to pursue political agenda shall be guilty of an offence:<\/span>
\n\uff08\u4e00\uff09\u9488\u5bf9\u4eba\u7684\u4e25\u91cd\u66b4\u529b\uff1b<\/span>
\n(1) serious violence against a person or persons;<\/span>
\n\uff08\u4e8c\uff09\u7206\u70b8\u3001\u7eb5\u706b\u6216\u8005\u6295\u653e\u6bd2\u5bb3\u6027\u3001\u653e\u5c04\u6027\u3001\u4f20\u67d3\u75c5\u75c5\u539f\u4f53\u7b49\u7269\u8d28\uff1b<\/span>
\n(2) explosion, arson, or dissemination of poisonous or radioactive substances, pathogens of infectious diseases or other substances;<\/span>
\n\uff08\u4e09\uff09\u7834\u574f\u4ea4\u901a\u5de5\u5177\u3001\u4ea4\u901a\u8bbe\u65bd\u3001\u7535\u529b\u8bbe\u5907\u3001\u71c3\u6c14\u8bbe\u5907\u6216\u8005\u5176\u4ed6\u6613\u71c3\u6613\u7206\u8bbe\u5907\uff1b<\/span>
\n(3) sabotage of means of transport, transport facilities, electric power or gas facilities, or other combustible or explosible facilities;<\/span>
\n\uff08\u56db\uff09\u4e25\u91cd\u5e72\u6270\u3001\u7834\u574f\u6c34\u3001\u7535\u3001\u71c3\u6c14\u3001\u4ea4\u901a\u3001\u901a\u8baf\u3001\u7f51\u7edc\u7b49\u516c\u5171\u670d\u52a1\u548c\u7ba1\u7406\u7684\u7535\u5b50\u63a7\u5236\u7cfb\u7edf\uff1b<\/span>
\n(4) serious interruption or sabotage of electronic control systems for providing and managing public services such as water, electric power, gas, transport, telecommunications and the internet; or<\/span>
\n\uff08\u4e94\uff09\u4ee5\u5176\u4ed6\u5371\u9669\u65b9\u6cd5\u4e25\u91cd\u5371\u5bb3\u516c\u4f17\u5065\u5eb7\u6216\u8005\u5b89\u5168\u3002<\/span>
\n(5) other dangerous activities which seriously jeopardise public health, safety or security.<\/span>
\n\u72af\u524d\u6b3e\u7f6a\uff0c\u81f4\u4eba\u91cd\u4f24\u3001\u6b7b\u4ea1\u6216\u8005\u4f7f\u516c\u79c1\u8d22\u4ea7\u906d\u53d7\u91cd\u5927\u635f\u5931\u7684\uff0c\u5904\u65e0\u671f\u5f92\u5211\u6216\u8005\u5341\u5e74\u4ee5\u4e0a\u6709\u671f\u5f92\u5211\uff1b\u5176\u4ed6\u60c5\u5f62\uff0c\u5904\u4e09\u5e74\u4ee5\u4e0a\u5341\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\u3002<\/span>
\nA person who commits the offence causing serious bodily injury, death or significant loss of public or private property shall be sentenced to life imprisonment or fixed-term imprisonment of not less than ten years; in other circumstances, a person who commits the offence shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.<\/span>
\n\u7b2c\u4e8c\u5341\u4e94\u6761\u3000\u7ec4\u7ec7\u3001\u9886\u5bfc\u6050\u6016\u6d3b\u52a8\u7ec4\u7ec7\u7684\uff0c\u5373\u5c5e\u72af\u7f6a\uff0c\u5904\u65e0\u671f\u5f92\u5211\u6216\u8005\u5341\u5e74\u4ee5\u4e0a\u6709\u671f\u5f92\u5211\uff0c\u5e76\u5904\u6ca1\u6536\u8d22\u4ea7\uff1b\u79ef\u6781\u53c2\u52a0\u7684\uff0c\u5904\u4e09\u5e74\u4ee5\u4e0a\u5341\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\uff0c\u5e76\u5904\u7f5a\u91d1\uff1b\u5176\u4ed6\u53c2\u52a0\u7684\uff0c\u5904\u4e09\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\u3001\u62d8\u5f79\u6216\u8005\u7ba1\u5236\uff0c\u53ef\u4ee5\u5e76\u5904\u7f5a\u91d1\u3002<\/span>
\nArticle 25 A person who organises or takes charge of a terrorist organisation shall be guilty of an offence and shall be sentenced to life imprisonment or fixed-term imprisonment of not less than ten years, and shall be subject to confiscation of property; a person who actively participates in a terrorist organisation shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall be imposed with a criminal fine; and other participants shall be sentenced to fixed-term imprisonment of not more than three years, short-term detention or restriction, and shall be liable to a criminal fine.<\/span>
\n\u672c\u6cd5\u6240\u6307\u7684\u6050\u6016\u6d3b\u52a8\u7ec4\u7ec7\uff0c\u662f\u6307\u5b9e\u65bd\u6216\u8005\u610f\u56fe\u5b9e\u65bd\u672c\u6cd5\u7b2c\u4e8c\u5341\u56db\u6761\u89c4\u5b9a\u7684\u6050\u6016\u6d3b\u52a8\u7f6a\u884c\u6216\u8005\u53c2\u4e0e\u6216\u8005\u534f\u52a9\u5b9e\u65bd\u672c\u6cd5\u7b2c\u4e8c\u5341\u56db\u6761\u89c4\u5b9a\u7684\u6050\u6016\u6d3b\u52a8\u7f6a\u884c\u7684\u7ec4\u7ec7\u3002<\/span>
\nFor the purpose of this Law, a terrorist organisation means an organisation which commits or intends to commit the offence under Article 24 of this Law or participates or assists in the commission of the offence.<\/span>
\n\u7b2c\u4e8c\u5341\u516d\u6761\u3000\u4e3a\u6050\u6016\u6d3b\u52a8\u7ec4\u7ec7\u3001\u6050\u6016\u6d3b\u52a8\u4eba\u5458\u3001\u6050\u6016\u6d3b\u52a8\u5b9e\u65bd\u63d0\u4f9b\u57f9\u8bad\u3001\u6b66\u5668\u3001\u4fe1\u606f\u3001\u8d44\u91d1\u3001\u7269\u8d44\u3001\u52b3\u52a1\u3001\u8fd0\u8f93\u3001\u6280\u672f\u6216\u8005\u573a\u6240\u7b49\u652f\u6301\u3001\u534f\u52a9\u3001\u4fbf\u5229\uff0c\u6216\u8005\u5236\u9020\u3001\u975e\u6cd5\u7ba1\u6709\u7206\u70b8\u6027\u3001\u6bd2\u5bb3\u6027\u3001\u653e\u5c04\u6027\u3001\u4f20\u67d3\u75c5\u75c5\u539f\u4f53\u7b49\u7269\u8d28\u4ee5\u53ca\u4ee5\u5176\u4ed6\u5f62\u5f0f\u51c6\u5907\u5b9e\u65bd\u6050\u6016\u6d3b\u52a8\u7684\uff0c\u5373\u5c5e\u72af\u7f6a\u3002\u60c5\u8282\u4e25\u91cd\u7684\uff0c\u5904\u4e94\u5e74\u4ee5\u4e0a\u5341\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\uff0c\u5e76\u5904\u7f5a\u91d1\u6216\u8005\u6ca1\u6536\u8d22\u4ea7\uff1b\u5176\u4ed6\u60c5\u5f62\uff0c\u5904\u4e94\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\u3001\u62d8\u5f79\u6216\u8005\u7ba1\u5236\uff0c\u5e76\u5904\u7f5a\u91d1\u3002<\/span>
\nArticle 26 A person who provides support, assistance or facility such as training, weapons, information, funds, supplies, labour, transport, technologies or venues to a terrorist organisation or a terrorist, or for the commission of a terrorist activity; or manufactures or illegally possesses substances such as explosive, poisonous or radioactive substances and pathogens of infectious diseases or uses other means to prepare for the commission of a terrorist activity, shall be guilty of an offence. If the circumstances of the offence committed by a person are of a serious nature, the person shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall be imposed with a criminal fine or subject to confiscation of property; in other circumstances, a person shall be sentenced to fixed-term imprisonment of not more than five years, short-term detention or restriction, and shall be imposed with a criminal fine.<\/span>
\n\u6709\u524d\u6b3e\u884c\u4e3a\uff0c\u540c\u65f6\u6784\u6210\u5176\u4ed6\u72af\u7f6a\u7684\uff0c\u4f9d\u7167\u5904\u7f5a\u8f83\u91cd\u7684\u89c4\u5b9a\u5b9a\u7f6a\u5904\u7f5a\u3002<\/span>
\nIf the act referred to in the preceding paragraph also constitutes other offences, the person who commits the act shall be convicted and sentenced for the offence that carries a more severe penalty.<\/span>
\n\u7b2c\u4e8c\u5341\u4e03\u6761\u3000\u5ba3\u626c\u6050\u6016\u4e3b\u4e49\u3001\u717d\u52a8\u5b9e\u65bd\u6050\u6016\u6d3b\u52a8\u7684\uff0c\u5373\u5c5e\u72af\u7f6a\u3002\u60c5\u8282\u4e25\u91cd\u7684\uff0c\u5904\u4e94\u5e74\u4ee5\u4e0a\u5341\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\uff0c\u5e76\u5904\u7f5a\u91d1\u6216\u8005\u6ca1\u6536\u8d22\u4ea7\uff1b\u5176\u4ed6\u60c5\u5f62\uff0c\u5904\u4e94\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\u3001\u62d8\u5f79\u6216\u8005\u7ba1\u5236\uff0c\u5e76\u5904\u7f5a\u91d1\u3002<\/span>
\nArticle 27 A person who advocates terrorism or incites the commission of a terrorist activity shall be guilty of an offence. If the circumstances of the offence committed by a person are of a serious nature, the person shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall be imposed with a criminal fine or subject to confiscation of property; in other circumstances, a person shall be sentenced to fixed-term imprisonment of not more than five years, short-term detention or restriction, and shall be imposed with a criminal fine.<\/span>
\n\u7b2c\u4e8c\u5341\u516b\u6761\u3000\u672c\u8282\u89c4\u5b9a\u4e0d\u5f71\u54cd\u4f9d\u636e\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6cd5\u5f8b\u5bf9\u5176\u4ed6\u5f62\u5f0f\u7684\u6050\u6016\u6d3b\u52a8\u72af\u7f6a\u8ffd\u7a76\u5211\u4e8b\u8d23\u4efb\u5e76\u91c7\u53d6\u51bb\u7ed3\u8d22\u4ea7\u7b49\u63aa\u65bd\u3002<\/span>
\nArticle 28 The provisions of this Part shall not affect the prosecution of terrorist offences committed in other forms or the imposition of other measures such as freezing of property in accordance with the laws of the Hong Kong Special Administrative Region.<\/span>

\nArticle 29 A person who steals, spies, obtains with payment, or unlawfully provides State secrets or intelligence concerning national security for a foreign country or an institution, organisation or individual outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China shall be guilty of an offence; a person who requests a foreign country or an institution, organisation or individual outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China, or conspires with a foreign country or an institution, organisation or individual outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China, or directly or indirectly receives instructions, control, funding or other kinds of support from a foreign country or an institution, organisation or individual outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China, to commit any of the following acts shall be guilty of an offence:<\/span>
\n\uff08\u4e00\uff09\u5bf9\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u53d1\u52a8\u6218\u4e89\uff0c\u6216\u8005\u4ee5\u6b66\u529b\u6216\u8005\u6b66\u529b\u76f8\u5a01\u80c1\uff0c\u5bf9\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u4e3b\u6743\u3001\u7edf\u4e00\u548c\u9886\u571f\u5b8c\u6574\u9020\u6210\u4e25\u91cd\u5371\u5bb3\uff1b<\/span>
\n(1) waging a war against the People\u2019s Republic of China, or using or threatening to use force to seriously undermine the sovereignty, unification and territorial integrity of the People\u2019s Republic of China;<\/span>
\n\uff08\u4e8c\uff09\u5bf9\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u6216\u8005\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u5236\u5b9a\u548c\u6267\u884c\u6cd5\u5f8b\u3001\u653f\u7b56\u8fdb\u884c\u4e25\u91cd\u963b\u6320\u5e76\u53ef\u80fd\u9020\u6210\u4e25\u91cd\u540e\u679c\uff1b<\/span>
\n(2) seriously disrupting the formulation and implementation of laws or policies by the Government of the Hong Kong Special Administrative Region or by the Central People\u2019s Government, which is likely to cause serious consequences;<\/span>
\n\uff08\u4e09\uff09\u5bf9\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u9009\u4e3e\u8fdb\u884c\u64cd\u63a7\u3001\u7834\u574f\u5e76\u53ef\u80fd\u9020\u6210\u4e25\u91cd\u540e\u679c\uff1b<\/span>
\n(3) rigging or undermining an election in the Hong Kong Special Administrative Region, which is likely to cause serious consequences;<\/span>
\n\uff08\u56db\uff09\u5bf9\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6216\u8005\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u8fdb\u884c\u5236\u88c1\u3001\u5c01\u9501\u6216\u8005\u91c7\u53d6\u5176\u4ed6\u654c\u5bf9\u884c\u52a8\uff1b<\/span>
\n(4) imposing sanctions or blockade, or engaging in other hostile activities against the Hong Kong Special Administrative Region or the People\u2019s Republic of China; or<\/span>
\n\uff08\u4e94\uff09\u901a\u8fc7\u5404\u79cd\u975e\u6cd5\u65b9\u5f0f\u5f15\u53d1\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5c45\u6c11\u5bf9\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u6216\u8005\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u7684\u618e\u6068\u5e76\u53ef\u80fd\u9020\u6210\u4e25\u91cd\u540e\u679c\u3002<\/span>
\n(5) provoking by unlawful means hatred among Hong Kong residents towards the Central People\u2019s Government or the Government of the Region, which is likely to cause serious consequences.<\/span>
\n\u72af\u524d\u6b3e\u7f6a\uff0c\u5904\u4e09\u5e74\u4ee5\u4e0a\u5341\u5e74\u4ee5\u4e0b\u6709\u671f\u5f92\u5211\uff1b\u7f6a\u884c\u91cd\u5927\u7684\uff0c\u5904\u65e0\u671f\u5f92\u5211\u6216\u8005\u5341\u5e74\u4ee5\u4e0a\u6709\u671f\u5f92\u5211\u3002<\/span>
\nA person who commits the offence shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; a person who commits an offence of a grave nature shall be sentenced to life imprisonment or fixed-term imprisonment of not less than ten years.<\/span>
\n\u672c\u6761\u7b2c\u4e00\u6b3e\u89c4\u5b9a\u6d89\u53ca\u7684\u5883\u5916\u673a\u6784\u3001\u7ec4\u7ec7\u3001\u4eba\u5458\uff0c\u6309\u5171\u540c\u72af\u7f6a\u5b9a\u7f6a\u5904\u5211\u3002<\/span>
\nThe institution, organisation and individual outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China referred to in the first paragraph of this Article shall be convicted and punished for the same offence.<\/span>
\n\u7b2c\u4e09\u5341\u6761\u3000\u4e3a\u5b9e\u65bd\u672c\u6cd5\u7b2c\u4e8c\u5341\u6761\u3001\u7b2c\u4e8c\u5341\u4e8c\u6761\u89c4\u5b9a\u7684\u72af\u7f6a\uff0c\u4e0e\u5916\u56fd\u6216\u8005\u5883\u5916\u673a\u6784\u3001\u7ec4\u7ec7\u3001\u4eba\u5458\u4e32\u8c0b\uff0c\u6216\u8005\u76f4\u63a5\u6216\u8005\u95f4\u63a5\u63a5\u53d7\u5916\u56fd\u6216\u8005\u5883\u5916\u673a\u6784\u3001\u7ec4\u7ec7\u3001\u4eba\u5458\u7684\u6307\u4f7f\u3001\u63a7\u5236\u3001\u8d44\u52a9\u6216\u8005\u5176\u4ed6\u5f62\u5f0f\u7684\u652f\u63f4\u7684\uff0c\u4f9d\u7167\u672c\u6cd5\u7b2c\u4e8c\u5341\u6761\u3001\u7b2c\u4e8c\u5341\u4e8c\u6761\u7684\u89c4\u5b9a\u4ece\u91cd\u5904\u7f5a\u3002<\/span>
\nArticle 30 A person who conspires with or directly or indirectly receives instructions, control, funding or other kinds of support from a foreign country or an institution, organisation, or individual outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China to commit the offences under Article 20 or 22 of this Law shall be liable to a more severe penalty in accordance with the provisions therein respectively.<\/span>
\n\u7b2c\u4e94\u8282\u3000\u5176\u4ed6\u5904\u7f5a\u89c4\u5b9a<\/span>
\nPart 5 Other Provisions on Penalty<\/span>
\n\u7b2c\u4e09\u5341\u4e00\u6761\u3000\u516c\u53f8\u3001\u56e2\u4f53\u7b49\u6cd5\u4eba\u6216\u8005\u975e\u6cd5\u4eba\u7ec4\u7ec7\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u7684\uff0c\u5bf9\u8be5\u7ec4\u7ec7\u5224\u5904\u7f5a\u91d1\u3002<\/span>
\nArticle 31 An incorporated or unincorporated body such as a company or an organisation which commits an offence under this Law shall be imposed with a criminal fine.<\/span>
\n\u516c\u53f8\u3001\u56e2\u4f53\u7b49\u6cd5\u4eba\u6216\u8005\u975e\u6cd5\u4eba\u7ec4\u7ec7\u56e0\u72af\u672c\u6cd5\u89c4\u5b9a\u7684\u7f6a\u884c\u53d7\u5230\u5211\u4e8b\u5904\u7f5a\u7684\uff0c\u5e94\u8d23\u4ee4\u5176\u6682\u505c\u8fd0\u4f5c\u6216\u8005\u540a\u9500\u5176\u6267\u7167\u6216\u8005\u8425\u4e1a\u8bb8\u53ef\u8bc1\u3002<\/span>
\nThe operation of an incorporated or unincorporated body such as a company or an organisation shall be suspended or its licence or business permit shall be revoked if the body has been punished for committing an offence under this Law.<\/span>
\n\u7b2c\u4e09\u5341\u4e8c\u6761\u3000\u56e0\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u800c\u83b7\u5f97\u7684\u8d44\u52a9\u3001\u6536\u76ca\u3001\u62a5\u916c\u7b49\u8fdd\u6cd5\u6240\u5f97\u4ee5\u53ca\u7528\u4e8e\u6216\u8005\u610f\u56fe\u7528\u4e8e\u72af\u7f6a\u7684\u8d44\u91d1\u548c\u5de5\u5177\uff0c\u5e94\u5f53\u4e88\u4ee5\u8ffd\u7f34\u3001\u6ca1\u6536\u3002<\/span>
\nArticle 32 Proceeds obtained from the commission of an offence under this Law including financial aid, gains and rewards, and funds and tools used or intended to be used in the commission of the offence shall be seized and confiscated.<\/span>
\n\u7b2c\u4e09\u5341\u4e09\u6761\u3000\u6709\u4ee5\u4e0b\u60c5\u5f62\u7684\uff0c\u5bf9\u6709\u5173\u72af\u7f6a\u884c\u4e3a\u4eba\u3001\u72af\u7f6a\u5acc\u7591\u4eba\u3001\u88ab\u544a\u4eba\u53ef\u4ee5\u4ece\u8f7b\u3001\u51cf\u8f7b\u5904\u7f5a\uff1b\u72af\u7f6a\u8f83\u8f7b\u7684\uff0c\u53ef\u4ee5\u514d\u9664\u5904\u7f5a\uff1a<\/span>
\nArticle 33 A lighter penalty may be imposed, or the penalty may be reduced or, in the case of a minor offence, exempted, if an offender, criminal suspect, or defendant:<\/span>
\n\uff08\u4e00\uff09\u5728\u72af\u7f6a\u8fc7\u7a0b\u4e2d\uff0c\u81ea\u52a8\u653e\u5f03\u72af\u7f6a\u6216\u8005\u81ea\u52a8\u6709\u6548\u5730\u9632\u6b62\u72af\u7f6a\u7ed3\u679c\u53d1\u751f\u7684\uff1b<\/span>
\n(1) in the process of committing an offence, voluntarily discontinues the commission of the offence or voluntarily and effectively forestalls its consequences;<\/span>
\n\uff08\u4e8c\uff09\u81ea\u52a8\u6295\u6848\uff0c\u5982\u5b9e\u4f9b\u8ff0\u81ea\u5df1\u7684\u7f6a\u884c\u7684\uff1b<\/span>
\n(2) voluntarily surrenders himself or herself and gives a truthful account of the offence; or<\/span>
\n\uff08\u4e09\uff09\u63ed\u53d1\u4ed6\u4eba\u72af\u7f6a\u884c\u4e3a\uff0c\u67e5\u8bc1\u5c5e\u5b9e\uff0c\u6216\u8005\u63d0\u4f9b\u91cd\u8981\u7ebf\u7d22\u5f97\u4ee5\u4fa6\u7834\u5176\u4ed6\u6848\u4ef6\u7684\u3002<\/span>
\n(3) reports on the offence committed by other person, which is verified to be true, or provides material information which assists in solving other criminal case.<\/span>
\n\u88ab\u91c7\u53d6\u5f3a\u5236\u63aa\u65bd\u7684\u72af\u7f6a\u5acc\u7591\u4eba\u3001\u88ab\u544a\u4eba\u5982\u5b9e\u4f9b\u8ff0\u6267\u6cd5\u3001\u53f8\u6cd5\u673a\u5173\u672a\u638c\u63e1\u7684\u672c\u4eba\u72af\u6709\u672c\u6cd5\u89c4\u5b9a\u7684\u5176\u4ed6\u7f6a\u884c\u7684\uff0c\u6309\u524d\u6b3e\u7b2c\u4e8c\u9879\u89c4\u5b9a\u5904\u7406\u3002<\/span>
\nSub-paragraph (2) of the preceding paragraph shall apply to a criminal suspect or defendant who is subjected to mandatory measures and provides a truthful account of other offences committed by him or her under this Law which are unknown to the law enforcement or judicial authorities.<\/span>
\n\u7b2c\u4e09\u5341\u56db\u6761\u3000\u4e0d\u5177\u6709\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6c38\u4e45\u6027\u5c45\u6c11\u8eab\u4efd\u7684\u4eba\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u7684\uff0c\u53ef\u4ee5\u72ec\u7acb\u9002\u7528\u6216\u8005\u9644\u52a0\u9002\u7528\u9a71\u9010\u51fa\u5883\u3002<\/span>
\nArticle 34 A person who is not a permanent resident of the Hong Kong Special Administrative Region may be subject to deportation as the sole or an additional punishment if he or she commits an offence under this Law.<\/span>
\n\u4e0d\u5177\u6709\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6c38\u4e45\u6027\u5c45\u6c11\u8eab\u4efd\u7684\u4eba\u8fdd\u53cd\u672c\u6cd5\u89c4\u5b9a\uff0c\u56e0\u4efb\u4f55\u539f\u56e0\u4e0d\u5bf9\u5176\u8ffd\u7a76\u5211\u4e8b\u8d23\u4efb\u7684\uff0c\u4e5f\u53ef\u4ee5\u9a71\u9010\u51fa\u5883\u3002<\/span>
\nA person who is not a permanent resident of the Region may be subject to deportation if he or she contravenes the provisions of this Law but is not prosecuted for any reason.<\/span>
\n\u7b2c\u4e09\u5341\u4e94\u6761\u3000\u4efb\u4f55\u4eba\u7ecf\u6cd5\u9662\u5224\u51b3\u72af\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u7f6a\u884c\u7684\uff0c\u5373\u4e27\u5931\u4f5c\u4e3a\u5019\u9009\u4eba\u53c2\u52a0\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4e3e\u884c\u7684\u7acb\u6cd5\u4f1a\u3001\u533a\u8bae\u4f1a\u9009\u4e3e\u6216\u8005\u51fa\u4efb\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4efb\u4f55\u516c\u804c\u6216\u8005\u884c\u653f\u957f\u5b98\u9009\u4e3e\u59d4\u5458\u4f1a\u59d4\u5458\u7684\u8d44\u683c\uff1b\u66fe\u7ecf\u5ba3\u8a93\u6216\u8005\u58f0\u660e\u62e5\u62a4\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u57fa\u672c\u6cd5\u3001\u6548\u5fe0\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7684\u7acb\u6cd5\u4f1a\u8bae\u5458\u3001\u653f\u5e9c\u5b98\u5458\u53ca\u516c\u52a1\u4eba\u5458\u3001\u884c\u653f\u4f1a\u8bae\u6210\u5458\u3001\u6cd5\u5b98\u53ca\u5176\u4ed6\u53f8\u6cd5\u4eba\u5458\u3001\u533a\u8bae\u5458\uff0c\u5373\u65f6\u4e27\u5931\u8be5\u7b49\u804c\u52a1\uff0c\u5e76\u4e27\u5931\u53c2\u9009\u6216\u8005\u51fa\u4efb\u4e0a\u8ff0\u804c\u52a1\u7684\u8d44\u683c\u3002<\/span>
\nArticle 35 A person who is convicted of an offence endangering national security by a court shall be disqualified from standing as a candidate in the elections of the Legislative Council and district councils of the Hong Kong Special Administrative Region, holding any public office in the Region, or serving as a member of the Election Committee for electing the Chief Executive. If a person so convicted is a member of the Legislative Council, a government official, a public servant, a member of the Executive Council, a judge or a judicial officer, or a member of the district councils, who has taken an oath or made a declaration to uphold the Basic Law of the Hong Kong Special Administrative Region of the People\u2019s Republic of China and swear allegiance to the Hong Kong Special Administrative Region of the People\u2019s Republic of China, he or she shall be removed from his or her office upon conviction, and shall be disqualified from standing for the aforementioned elections or from holding any of the aforementioned posts.<\/span>
\n\u524d\u6b3e\u89c4\u5b9a\u8d44\u683c\u6216\u8005\u804c\u52a1\u7684\u4e27\u5931\uff0c\u7531\u8d1f\u8d23\u7ec4\u7ec7\u3001\u7ba1\u7406\u6709\u5173\u9009\u4e3e\u6216\u8005\u516c\u804c\u4efb\u514d\u7684\u673a\u6784\u5ba3\u5e03\u3002<\/span>
\nThe disqualification and removal from offices referred to in the preceding paragraph shall be announced by the authorities responsible for organising and managing the relevant elections or for the appointment and removal of holders of public office.<\/span>
\n\u7b2c\u516d\u8282\u3000\u6548\u529b\u8303\u56f4<\/span>
\nPart 6 Scope of Application<\/span>
\n\u7b2c\u4e09\u5341\u516d\u6761\u3000\u4efb\u4f55\u4eba\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5185\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u7684\uff0c\u9002\u7528\u672c\u6cd5\u3002\u72af\u7f6a\u7684\u884c\u4e3a\u6216\u8005\u7ed3\u679c\u6709\u4e00\u9879\u53d1\u751f\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5185\u7684\uff0c\u5c31\u8ba4\u4e3a\u662f\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5185\u72af\u7f6a\u3002<\/span>
\nArticle 36 This Law shall apply to offences under this Law which are committed in the Hong Kong Special Administrative Region by any person. An offence shall be deemed to have been committed in the Region if an act constituting the offence or the consequence of the offence occurs in the Region.<\/span>
\n\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6ce8\u518c\u7684\u8239\u8236\u6216\u8005\u822a\u7a7a\u5668\u5185\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u7684\uff0c\u4e5f\u9002\u7528\u672c\u6cd5\u3002<\/span>
\nThis Law shall also apply to offences under this Law committed on board a vessel or aircraft registered in the Region.<\/span>
\n\u7b2c\u4e09\u5341\u4e03\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6c38\u4e45\u6027\u5c45\u6c11\u6216\u8005\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6210\u7acb\u7684\u516c\u53f8\u3001\u56e2\u4f53\u7b49\u6cd5\u4eba\u6216\u8005\u975e\u6cd5\u4eba\u7ec4\u7ec7\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4ee5\u5916\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u7684\uff0c\u9002\u7528\u672c\u6cd5\u3002<\/span>
\nArticle 37 This Law shall apply to a person who is a permanent resident of the Hong Kong Special Administrative Region or an incorporated or unincorporated body such as a company or an organisation which is set up in the Region if the person or the body commits an offence under this Law outside the Region.<\/span>
\n\u7b2c\u4e09\u5341\u516b\u6761\u3000\u4e0d\u5177\u6709\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6c38\u4e45\u6027\u5c45\u6c11\u8eab\u4efd\u7684\u4eba\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4ee5\u5916\u9488\u5bf9\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5b9e\u65bd\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u7684\uff0c\u9002\u7528\u672c\u6cd5\u3002<\/span>
\nArticle 38 This Law shall apply to offences under this Law committed against the Hong Kong Special Administrative Region from outside the Region by a person who is not a permanent resident of the Region.<\/span>
\n\u7b2c\u4e09\u5341\u4e5d\u6761\u3000\u672c\u6cd5\u65bd\u884c\u4ee5\u540e\u7684\u884c\u4e3a\uff0c\u9002\u7528\u672c\u6cd5\u5b9a\u7f6a\u5904\u5211\u3002<\/span>
\nArticle 39 This Law shall apply to acts committed after its entry into force for the purpose of conviction and imposition of punishment.<\/span>
\n\u7b2c\u56db\u7ae0\u3000\u6848\u4ef6\u7ba1\u8f96\u3001\u6cd5\u5f8b\u9002\u7528\u548c\u7a0b\u5e8f<\/span>
\nChapter IV Jurisdiction, Applicable Law and Procedure<\/span>
\n\u7b2c\u56db\u5341\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5bf9\u672c\u6cd5\u89c4\u5b9a\u7684\u72af\u7f6a\u6848\u4ef6\u884c\u4f7f\u7ba1\u8f96\u6743\uff0c\u4f46\u672c\u6cd5\u7b2c\u4e94\u5341\u4e94\u6761\u89c4\u5b9a\u7684\u60c5\u5f62\u9664\u5916\u3002<\/span>
\nArticle 40 The Hong Kong Special Administrative Region shall have jurisdiction over cases concerning offences under this Law, except under the circumstances specified in Article 55 of this Law.<\/span>
\n\u7b2c\u56db\u5341\u4e00\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ba1\u8f96\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u7684\u7acb\u6848\u4fa6\u67e5\u3001\u68c0\u63a7\u3001\u5ba1\u5224\u548c\u5211\u7f5a\u7684\u6267\u884c\u7b49\u8bc9\u8bbc\u7a0b\u5e8f\u4e8b\u5b9c\uff0c\u9002\u7528\u672c\u6cd5\u548c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u672c\u5730\u6cd5\u5f8b\u3002<\/span>
\nArticle 41 This Law and the laws of the Hong Kong Special Administrative Region shall apply to procedural matters, including those related to criminal investigation, prosecution, trial, and execution of penalty, in respect of cases concerning offence endangering national security over which the Region exercises jurisdiction.<\/span>
\n\u672a\u7ecf\u5f8b\u653f\u53f8\u957f\u4e66\u9762\u540c\u610f\uff0c\u4efb\u4f55\u4eba\u4e0d\u5f97\u5c31\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u63d0\u51fa\u68c0\u63a7\u3002\u4f46\u8be5\u89c4\u5b9a\u4e0d\u5f71\u54cd\u5c31\u6709\u5173\u72af\u7f6a\u4f9d\u6cd5\u902e\u6355\u72af\u7f6a\u5acc\u7591\u4eba\u5e76\u5c06\u5176\u7f81\u62bc\uff0c\u4e5f\u4e0d\u5f71\u54cd\u8be5\u7b49\u72af\u7f6a\u5acc\u7591\u4eba\u7533\u8bf7\u4fdd\u91ca\u3002<\/span>
\nNo prosecution shall be instituted in respect of an offence endangering national security without the written consent of the Secretary for Justice. This provision shall not prejudice the arrest and detention of a person who is suspected of having committed the offence or the application for bail by the person in accordance with the law.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ba1\u8f96\u7684\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u7684\u5ba1\u5224\u5faa\u516c\u8bc9\u7a0b\u5e8f\u8fdb\u884c\u3002<\/span>
\nCases concerning offence endangering national security within the jurisdiction of the Hong Kong Special Administrative Region shall be tried on indictment.<\/span>
\n\u5ba1\u5224\u5e94\u5f53\u516c\u5f00\u8fdb\u884c\u3002\u56e0\u4e3a\u6d89\u53ca\u56fd\u5bb6\u79d8\u5bc6\u3001\u516c\u5171\u79e9\u5e8f\u7b49\u60c5\u5f62\u4e0d\u5b9c\u516c\u5f00\u5ba1\u7406\u7684\uff0c\u7981\u6b62\u65b0\u95fb\u754c\u548c\u516c\u4f17\u65c1\u542c\u5168\u90e8\u6216\u8005\u4e00\u90e8\u5206\u5ba1\u7406\u7a0b\u5e8f\uff0c\u4f46\u5224\u51b3\u7ed3\u679c\u5e94\u5f53\u4e00\u5f8b\u516c\u5f00\u5ba3\u5e03\u3002<\/span>
\nThe trial shall be conducted in an open court. When circumstances arise such as the trial involving State secrets or public order, all or part of the trial shall be closed to the media and the public but the judgment shall be delivered in an open court.<\/span>
\n\u7b2c\u56db\u5341\u4e8c\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6267\u6cd5\u3001\u53f8\u6cd5\u673a\u5173\u5728\u9002\u7528\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u73b0\u884c\u6cd5\u5f8b\u6709\u5173\u7f81\u62bc\u3001\u5ba1\u7406\u671f\u9650\u7b49\u65b9\u9762\u7684\u89c4\u5b9a\u65f6\uff0c\u5e94\u5f53\u786e\u4fdd\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u516c\u6b63\u3001\u53ca\u65f6\u529e\u7406\uff0c\u6709\u6548\u9632\u8303\u3001\u5236\u6b62\u548c\u60e9\u6cbb\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u3002<\/span>
\nArticle 42 When applying the laws in force in the Hong Kong Special Administrative Region concerning matters such as the detention and time limit for trial, the law enforcement and judicial authorities of the Region shall ensure that cases concerning offence endangering national security are handled in a fair and timely manner so as to effectively prevent, suppress and impose punishment for such offence.<\/span>
\n\u5bf9\u72af\u7f6a\u5acc\u7591\u4eba\u3001\u88ab\u544a\u4eba\uff0c\u9664\u975e\u6cd5\u5b98\u6709\u5145\u8db3\u7406\u7531\u76f8\u4fe1\u5176\u4e0d\u4f1a\u7ee7\u7eed\u5b9e\u65bd\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u884c\u4e3a\u7684\uff0c\u4e0d\u5f97\u51c6\u4e88\u4fdd\u91ca\u3002<\/span>
\nNo bail shall be granted to a criminal suspect or defendant unless the judge has sufficient grounds for believing that the criminal suspect or defendant will not continue to commit acts endangering national security.<\/span>
\n\u7b2c\u56db\u5341\u4e09\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u529e\u7406\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u65f6\uff0c\u53ef\u4ee5\u91c7\u53d6\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u73b0\u884c\u6cd5\u5f8b\u51c6\u4e88\u8b66\u65b9\u7b49\u6267\u6cd5\u90e8\u95e8\u5728\u8c03\u67e5\u4e25\u91cd\u72af\u7f6a\u6848\u4ef6\u65f6\u91c7\u53d6\u7684\u5404\u79cd\u63aa\u65bd\uff0c\u5e76\u53ef\u4ee5\u91c7\u53d6\u4ee5\u4e0b\u63aa\u65bd\uff1a<\/span>
\nArticle 43 When handling cases concerning offence endangering national security, the department for safeguarding national security of the Police Force of the Hong Kong Special Administrative Region may take measures that law enforcement authorities, including the Hong Kong Police Force, are allowed to apply under the laws in force in the Hong Kong Special Administrative Region in investigating serious crimes, and may also take the following measures:<\/span>
\n\uff08\u4e00\uff09\u641c\u67e5\u53ef\u80fd\u5b58\u6709\u72af\u7f6a\u8bc1\u636e\u7684\u5904\u6240\u3001\u8f66\u8f86\u3001\u8239\u53ea\u3001\u822a\u7a7a\u5668\u4ee5\u53ca\u5176\u4ed6\u6709\u5173\u5730\u65b9\u548c\u7535\u5b50\u8bbe\u5907\uff1b<\/span>
\n(1) search of premises, vehicles, vessels, aircraft and other relevant places and electronic devices that may contain evidence of an offence;<\/span>
\n\uff08\u4e8c\uff09\u8981\u6c42\u6d89\u5acc\u5b9e\u65bd\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u884c\u4e3a\u7684\u4eba\u5458\u4ea4\u51fa\u65c5\u884c\u8bc1\u4ef6\u6216\u8005\u9650\u5236\u5176\u79bb\u5883\uff1b<\/span>
\n(2) ordering any person suspected of having committed an offence endangering national security to surrender travel documents, or prohibiting the person concerned from leaving the Region;<\/span>
\n\uff08\u4e09\uff09\u5bf9\u7528\u4e8e\u6216\u8005\u610f\u56fe\u7528\u4e8e\u72af\u7f6a\u7684\u8d22\u4ea7\u3001\u56e0\u72af\u7f6a\u6240\u5f97\u7684\u6536\u76ca\u7b49\u4e0e\u72af\u7f6a\u76f8\u5173\u7684\u8d22\u4ea7\uff0c\u4e88\u4ee5\u51bb\u7ed3\uff0c\u7533\u8bf7\u9650\u5236\u4ee4\u3001\u62bc\u8bb0\u4ee4\u3001\u6ca1\u6536\u4ee4\u4ee5\u53ca\u5145\u516c\uff1b<\/span>
\n(3) freezing of, applying for restraint order, charging order and confiscation order in respect of, and forfeiture of property used or intended to be used for the commission of the offence, proceeds of crime, or other property relating to the commission of the offence;<\/span>
\n\uff08\u56db\uff09\u8981\u6c42\u4fe1\u606f\u53d1\u5e03\u4eba\u6216\u8005\u6709\u5173\u670d\u52a1\u5546\u79fb\u9664\u4fe1\u606f\u6216\u8005\u63d0\u4f9b\u534f\u52a9\uff1b<\/span>
\n(4) requiring a person who published information or the relevant service provider to delete the information or provide assistance;<\/span>
\n\uff08\u4e94\uff09\u8981\u6c42\u5916\u56fd\u53ca\u5883\u5916\u653f\u6cbb\u6027\u7ec4\u7ec7\uff0c\u5916\u56fd\u53ca\u5883\u5916\u5f53\u5c40\u6216\u8005\u653f\u6cbb\u6027\u7ec4\u7ec7\u7684\u4ee3\u7406\u4eba\u63d0\u4f9b\u8d44\u6599\uff1b<\/span>
\n(5) requiring a political organisation of a foreign country or outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China, or an agent of authorities or a political organisation of a foreign country or outside the mainland, Hong Kong and Macao of the People\u2019s Republic of China, to provide information;<\/span>
\n\uff08\u516d\uff09\u7ecf\u884c\u653f\u957f\u5b98\u6279\u51c6\uff0c\u5bf9\u6709\u5408\u7406\u7406\u7531\u6000\u7591\u6d89\u53ca\u5b9e\u65bd\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u7684\u4eba\u5458\u8fdb\u884c\u622a\u53d6\u901a\u8baf\u548c\u79d8\u5bc6\u76d1\u5bdf\uff1b<\/span>
\n(6) upon approval of the Chief Executive, carrying out interception of communications and conducting covert surveillance on a person who is suspected, on reasonable grounds, of having involved in the commission of an offence endangering national security; and<\/span>
\n\uff08\u4e03\uff09\u5bf9\u6709\u5408\u7406\u7406\u7531\u6000\u7591\u62e5\u6709\u4e0e\u4fa6\u67e5\u6709\u5173\u7684\u8d44\u6599\u6216\u8005\u7ba1\u6709\u6709\u5173\u7269\u6599\u7684\u4eba\u5458\uff0c\u8981\u6c42\u5176\u56de\u7b54\u95ee\u9898\u548c\u63d0\u4ea4\u8d44\u6599\u6216\u8005\u7269\u6599\u3002<\/span>
\n(7) requiring a person, who is suspected, on reasonable grounds, of having in possession information or material relevant to investigation, to answer questions and furnish such information or produce such material.<\/span>
\n\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u5bf9\u8b66\u52a1\u5904\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u90e8\u95e8\u7b49\u6267\u6cd5\u673a\u6784\u91c7\u53d6\u672c\u6761\u7b2c\u4e00\u6b3e\u89c4\u5b9a\u63aa\u65bd\u8d1f\u6709\u76d1\u7763\u8d23\u4efb\u3002<\/span>
\nThe Committee for Safeguarding National Security of the Hong Kong Special Administrative Region shall be responsible for supervising the implementation of the measures stipulated in the first paragraph of this Article by law enforcement authorities including the department for safeguarding national security of the Hong Kong Police Force.<\/span>
\n\u6388\u6743\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u884c\u653f\u957f\u5b98\u4f1a\u540c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u4e3a\u91c7\u53d6\u672c\u6761\u7b2c\u4e00\u6b3e\u89c4\u5b9a\u63aa\u65bd\u5236\u5b9a\u76f8\u5173\u5b9e\u65bd\u7ec6\u5219\u3002<\/span>
\nThe Chief Executive shall be authorised, in conjunction with the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region, to make relevant implementation rules for the purpose of applying the measures under the first paragraph of this Article.<\/span>
\n\u7b2c\u56db\u5341\u56db\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u884c\u653f\u957f\u5b98\u5e94\u5f53\u4ece\u88c1\u5224\u5b98\u3001\u533a\u57df\u6cd5\u9662\u6cd5\u5b98\u3001\u9ad8\u7b49\u6cd5\u9662\u539f\u8bbc\u6cd5\u5ead\u6cd5\u5b98\u3001\u4e0a\u8bc9\u6cd5\u5ead\u6cd5\u5b98\u4ee5\u53ca\u7ec8\u5ba1\u6cd5\u9662\u6cd5\u5b98\u4e2d\u6307\u5b9a\u82e5\u5e72\u540d\u6cd5\u5b98\uff0c\u4e5f\u53ef\u4ece\u6682\u59d4\u6216\u8005\u7279\u59d4\u6cd5\u5b98\u4e2d\u6307\u5b9a\u82e5\u5e72\u540d\u6cd5\u5b98\uff0c\u8d1f\u8d23\u5904\u7406\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u3002\u884c\u653f\u957f\u5b98\u5728\u6307\u5b9a\u6cd5\u5b98\u524d\u53ef\u5f81\u8be2\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u548c\u7ec8\u5ba1\u6cd5\u9662\u9996\u5e2d\u6cd5\u5b98\u7684\u610f\u89c1\u3002\u4e0a\u8ff0\u6307\u5b9a\u6cd5\u5b98\u4efb\u671f\u4e00\u5e74\u3002<\/span>
\nArticle 44 The Chief Executive shall designate a number of judges from the magistrates, the judges of the District Court, the judges of the Court of First Instance and the Court of Appeal of the High Court, and the judges of the Court of Final Appeal, and may also designate a number of judges from deputy judges or recorders, to handle cases concerning offence endangering national security. Before making such designation, the Chief Executive may consult the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region and the Chief Justice of the Court of Final Appeal. The term of office of the aforementioned designated judges shall be one year.<\/span>
\n\u51e1\u6709\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u8a00\u884c\u7684\uff0c\u4e0d\u5f97\u88ab\u6307\u5b9a\u4e3a\u5ba1\u7406\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u7684\u6cd5\u5b98\u3002\u5728\u83b7\u4efb\u6307\u5b9a\u6cd5\u5b98\u671f\u95f4\uff0c\u5982\u6709\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u8a00\u884c\u7684\uff0c\u7ec8\u6b62\u5176\u6307\u5b9a\u6cd5\u5b98\u8d44\u683c\u3002<\/span>
\nA person shall not be designated as a judge to adjudicate a case concerning offence endangering national security if he or she has made any statement or behaved in any manner endangering national security. A designated judge shall be removed from the designation list if he or she makes any statement or behaves in any manner endangering national security during the term of office.<\/span>
\n\u5728\u88c1\u5224\u6cd5\u9662\u3001\u533a\u57df\u6cd5\u9662\u3001\u9ad8\u7b49\u6cd5\u9662\u548c\u7ec8\u5ba1\u6cd5\u9662\u5c31\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u63d0\u8d77\u7684\u5211\u4e8b\u68c0\u63a7\u7a0b\u5e8f\u5e94\u5f53\u5206\u522b\u7531\u5404\u8be5\u6cd5\u9662\u7684\u6307\u5b9a\u6cd5\u5b98\u5904\u7406\u3002<\/span>
\nThe proceedings in relation to the prosecution for offences endangering national security in the magistrates\u2019 courts, the District Court, the High Court and the Court of Final Appeal shall be handled by the designated judges in the respective courts.<\/span>
\n\u7b2c\u56db\u5341\u4e94\u6761\u3000\u9664\u672c\u6cd5\u53e6\u6709\u89c4\u5b9a\u5916\uff0c\u88c1\u5224\u6cd5\u9662\u3001\u533a\u57df\u6cd5\u9662\u3001\u9ad8\u7b49\u6cd5\u9662\u548c\u7ec8\u5ba1\u6cd5\u9662\u5e94\u5f53\u6309\u7167\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7684\u5176\u4ed6\u6cd5\u5f8b\u5904\u7406\u5c31\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u63d0\u8d77\u7684\u5211\u4e8b\u68c0\u63a7\u7a0b\u5e8f\u3002<\/span>
\nArticle 45 Unless otherwise provided by this Law, magistrates\u2019 courts, the District Court, the High Court and the Court of Final Appeal shall handle proceedings in relation to the prosecution for offences endangering national security in accordance with the laws of the Hong Kong Special Administrative Region.<\/span>
\n\u7b2c\u56db\u5341\u516d\u6761\u3000\u5bf9\u9ad8\u7b49\u6cd5\u9662\u539f\u8bbc\u6cd5\u5ead\u8fdb\u884c\u7684\u5c31\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u63d0\u8d77\u7684\u5211\u4e8b\u68c0\u63a7\u7a0b\u5e8f\uff0c\u5f8b\u653f\u53f8\u957f\u53ef\u57fa\u4e8e\u4fdd\u62a4\u56fd\u5bb6\u79d8\u5bc6\u3001\u6848\u4ef6\u5177\u6709\u6d89\u5916\u56e0\u7d20\u6216\u8005\u4fdd\u969c\u966a\u5ba1\u5458\u53ca\u5176\u5bb6\u4eba\u7684\u4eba\u8eab\u5b89\u5168\u7b49\u7406\u7531\uff0c\u53d1\u51fa\u8bc1\u4e66\u6307\u793a\u76f8\u5173\u8bc9\u8bbc\u6bcb\u987b\u5728\u6709\u966a\u5ba1\u56e2\u7684\u60c5\u51b5\u4e0b\u8fdb\u884c\u5ba1\u7406\u3002\u51e1\u5f8b\u653f\u53f8\u957f\u53d1\u51fa\u4e0a\u8ff0\u8bc1\u4e66\uff0c\u9ad8\u7b49\u6cd5\u9662\u539f\u8bbc\u6cd5\u5ead\u5e94\u5f53\u5728\u6ca1\u6709\u966a\u5ba1\u56e2\u7684\u60c5\u51b5\u4e0b\u8fdb\u884c\u5ba1\u7406\uff0c\u5e76\u7531\u4e09\u540d\u6cd5\u5b98\u7ec4\u6210\u5ba1\u5224\u5ead\u3002<\/span>
\nArticle 46 In criminal proceedings in the Court of First Instance of the High Court concerning offences endangering national security, the Secretary for Justice may issue a certificate directing that the case shall be tried without a jury on the grounds of, among others, the protection of State secrets, involvement of foreign factors in the case, and the protection of personal safety of jurors and their family members. Where the Secretary for Justice has issued the certificate, the case shall be tried in the Court of First Instance without a jury by a panel of three judges.<\/span>
\n\u51e1\u5f8b\u653f\u53f8\u957f\u53d1\u51fa\u524d\u6b3e\u89c4\u5b9a\u7684\u8bc1\u4e66\uff0c\u9002\u7528\u4e8e\u76f8\u5173\u8bc9\u8bbc\u7684\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u4efb\u4f55\u6cd5\u5f8b\u6761\u6587\u5173\u4e8e\u201c\u966a\u5ba1\u56e2\u201d\u6216\u8005\u201c\u966a\u5ba1\u56e2\u7684\u88c1\u51b3\u201d\uff0c\u5747\u5e94\u5f53\u7406\u89e3\u4e3a\u6307\u6cd5\u5b98\u6216\u8005\u6cd5\u5b98\u4f5c\u4e3a\u4e8b\u5b9e\u88c1\u65ad\u8005\u7684\u804c\u80fd\u3002<\/span>
\nWhere the Secretary for Justice has issued the certificate, the reference to \u201ca jury\u201d or \u201ca verdict of the jury\u201d in any provision of the laws of the Hong Kong Special Administrative Region applicable to the related proceedings shall be construed as referring to the judges or the functions of the judge as a judge of fact.<\/span>
\n\u7b2c\u56db\u5341\u4e03\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6cd5\u9662\u5728\u5ba1\u7406\u6848\u4ef6\u4e2d\u9047\u6709\u6d89\u53ca\u6709\u5173\u884c\u4e3a\u662f\u5426\u6d89\u53ca\u56fd\u5bb6\u5b89\u5168\u6216\u8005\u6709\u5173\u8bc1\u636e\u6750\u6599\u662f\u5426\u6d89\u53ca\u56fd\u5bb6\u79d8\u5bc6\u7684\u8ba4\u5b9a\u95ee\u9898\uff0c\u5e94\u53d6\u5f97\u884c\u653f\u957f\u5b98\u5c31\u8be5\u7b49\u95ee\u9898\u53d1\u51fa\u7684\u8bc1\u660e\u4e66\uff0c\u4e0a\u8ff0\u8bc1\u660e\u4e66\u5bf9\u6cd5\u9662\u6709\u7ea6\u675f\u529b\u3002<\/span>
\nArticle 47 The courts of the Hong Kong Special Administrative Region shall obtain a certificate from the Chief Executive to certify whether an act involves national security or whether the relevant evidence involves State secrets when such questions arise in the adjudication of a case. The certificate shall be binding on the courts.<\/span>

\nChapter V Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region<\/span>
\n\u7b2c\u56db\u5341\u516b\u6761\u3000\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u8bbe\u7acb\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u3002\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u4f9d\u6cd5\u5c65\u884c\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u804c\u8d23\uff0c\u884c\u4f7f\u76f8\u5173\u6743\u529b\u3002<\/span>
\nArticle 48 The Central People\u2019s Government shall establish in the Hong Kong Special Administrative Region an office for safeguarding national security. The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall perform its mandate for safeguarding national security and exercise relevant powers in accordance with the law.<\/span>
\n\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u4eba\u5458\u7531\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u6709\u5173\u673a\u5173\u8054\u5408\u6d3e\u51fa\u3002<\/span>
\nThe staff of the Office shall be jointly dispatched by relevant national security authorities under the Central People\u2019s Government.<\/span>
\n\u7b2c\u56db\u5341\u4e5d\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u7684\u804c\u8d23\u4e3a\uff1a<\/span>
\nArticle 49 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall perform the following mandate:<\/span>
\n\uff08\u4e00\uff09\u5206\u6790\u7814\u5224\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u5f62\u52bf\uff0c\u5c31\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u91cd\u5927\u6218\u7565\u548c\u91cd\u8981\u653f\u7b56\u63d0\u51fa\u610f\u89c1\u548c\u5efa\u8bae\uff1b<\/span>
\n(1) analysing and assessing developments in relation to safeguarding national security in the Hong Kong Special Administrative Region, and providing opinions and making proposals on major strategies and important policies for safeguarding national security;<\/span>
\n\uff08\u4e8c\uff09\u76d1\u7763\u3001\u6307\u5bfc\u3001\u534f\u8c03\u3001\u652f\u6301\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5c65\u884c\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u804c\u8d23\uff1b<\/span>
\n(2) overseeing, guiding, coordinating with, and providing support to the Region in the performance of its duties for safeguarding national security;<\/span>
\n\uff08\u4e09\uff09\u6536\u96c6\u5206\u6790\u56fd\u5bb6\u5b89\u5168\u60c5\u62a5\u4fe1\u606f\uff1b<\/span>
\n(3) collecting and analysing intelligence and information concerning national security; and<\/span>
\n\uff08\u56db\uff09\u4f9d\u6cd5\u529e\u7406\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u3002<\/span>
\n(4) handling cases concerning offence endangering national security in accordance with the law.<\/span>
\n\u7b2c\u4e94\u5341\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u5e94\u5f53\u4e25\u683c\u4f9d\u6cd5\u5c65\u884c\u804c\u8d23\uff0c\u4f9d\u6cd5\u63a5\u53d7\u76d1\u7763\uff0c\u4e0d\u5f97\u4fb5\u5bb3\u4efb\u4f55\u4e2a\u4eba\u548c\u7ec4\u7ec7\u7684\u5408\u6cd5\u6743\u76ca\u3002<\/span>
\nArticle 50 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall perform its mandate in strict compliance with the law and be subject to supervision in accordance with the law. It shall not infringe upon the lawful rights and interests of any individual or organisation.<\/span>
\n\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u4eba\u5458\u9664\u987b\u9075\u5b88\u5168\u56fd\u6027\u6cd5\u5f8b\u5916\uff0c\u8fd8\u5e94\u5f53\u9075\u5b88\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6cd5\u5f8b\u3002<\/span>
\nThe staff of the Office shall abide by the laws of the Hong Kong Special Administrative Region as well as national laws.<\/span>
\n\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u4eba\u5458\u4f9d\u6cd5\u63a5\u53d7\u56fd\u5bb6\u76d1\u5bdf\u673a\u5173\u7684\u76d1\u7763\u3002<\/span>
\nThe staff of the Office shall be subject to the supervision of the national supervisory authorities in accordance with the law.<\/span>
\n\u7b2c\u4e94\u5341\u4e00\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u7684\u7ecf\u8d39\u7531\u4e2d\u592e\u8d22\u653f\u4fdd\u969c\u3002<\/span>
\nArticle 51 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall be funded by the Central People\u2019s Government.<\/span>
\n\u7b2c\u4e94\u5341\u4e8c\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u5e94\u5f53\u52a0\u5f3a\u4e0e\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u8054\u7edc\u529e\u516c\u5ba4\u3001\u5916\u4ea4\u90e8\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7279\u6d3e\u5458\u516c\u7f72\u3001\u4e2d\u56fd\u4eba\u6c11\u89e3\u653e\u519b\u9a7b\u9999\u6e2f\u90e8\u961f\u7684\u5de5\u4f5c\u8054\u7cfb\u548c\u5de5\u4f5c\u534f\u540c\u3002<\/span>
\nArticle 52 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall strengthen working relations and cooperation with the Liaison Office of the Central People\u2019s Government in the Hong Kong Special Administrative Region, the Office of the Commissioner of the Ministry of Foreign Affairs in the Hong Kong Special Administrative Region, and the Hong Kong Garrison of the Chinese People\u2019s Liberation Army.<\/span>
\n\u7b2c\u4e94\u5341\u4e09\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u5e94\u5f53\u4e0e\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u59d4\u5458\u4f1a\u5efa\u7acb\u534f\u8c03\u673a\u5236\uff0c\u76d1\u7763\u3001\u6307\u5bfc\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u5de5\u4f5c\u3002<\/span>
\nArticle 53 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall establish a mechanism of coordination with the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region to oversee and provide guidance on the work of the Hong Kong Special Administrative Region for safeguarding national security.<\/span>
\n\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u7684\u5de5\u4f5c\u90e8\u95e8\u5e94\u5f53\u4e0e\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u7684\u6709\u5173\u673a\u5173\u5efa\u7acb\u534f\u4f5c\u673a\u5236\uff0c\u52a0\u5f3a\u4fe1\u606f\u5171\u4eab\u548c\u884c\u52a8\u914d\u5408\u3002<\/span>
\nThe working departments of the Office shall establish mechanisms for collaboration with the relevant authorities of the Region responsible for safeguarding national security to enhance information sharing and operations coordination.<\/span>
\n\u7b2c\u4e94\u5341\u56db\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u3001\u5916\u4ea4\u90e8\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7279\u6d3e\u5458\u516c\u7f72\u4f1a\u540c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u91c7\u53d6\u5fc5\u8981\u63aa\u65bd\uff0c\u52a0\u5f3a\u5bf9\u5916\u56fd\u548c\u56fd\u9645\u7ec4\u7ec7\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u673a\u6784\u3001\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7684\u5916\u56fd\u548c\u5883\u5916\u975e\u653f\u5e9c\u7ec4\u7ec7\u548c\u65b0\u95fb\u673a\u6784\u7684\u7ba1\u7406\u548c\u670d\u52a1\u3002<\/span>
\nArticle 54 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region and the Office of the Commissioner of the Ministry of Foreign Affairs in the Hong Kong Special Administrative Region shall, together with the Government of the Hong Kong Special Administrative Region, take necessary measures to strengthen the management of and services for organs of foreign countries and international organisations in the Region, as well as non-governmental organisations and news agencies of foreign countries and from outside the mainland, Hong Kong, and Macao of the People\u2019s Republic of China in the Region.<\/span>
\n\u7b2c\u4e94\u5341\u4e94\u6761\u3000\u6709\u4ee5\u4e0b\u60c5\u5f62\u4e4b\u4e00\u7684\uff0c\u7ecf\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u6216\u8005\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u63d0\u51fa\uff0c\u5e76\u62a5\u4e2d\u592e\u4eba\u6c11\u653f\u5e9c\u6279\u51c6\uff0c\u7531\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u5bf9\u672c\u6cd5\u89c4\u5b9a\u7684\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u884c\u4f7f\u7ba1\u8f96\u6743\uff1a<\/span>
\nArticle 54 The Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region and the Office of the Commissioner of the Ministry of Foreign Affairs in the Hong Kong Special Administrative Region shall, together with the Government of the Hong Kong Special Administrative Region, take necessary measures to strengthen the management of and services for organs of foreign countries and international organisations in the Region, as well as non-governmental organisations and news agencies of foreign countries and from outside the mainland, Hong Kong, and Macao of the People\u2019s Republic of China in the Region.<\/span>
\n\uff08\u4e00\uff09\u6848\u4ef6\u6d89\u53ca\u5916\u56fd\u6216\u8005\u5883\u5916\u52bf\u529b\u4ecb\u5165\u7684\u590d\u6742\u60c5\u51b5\uff0c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ba1\u8f96\u786e\u6709\u56f0\u96be\u7684\uff1b<\/span>
\n(1) the case is complex due to the involvement of a foreign country or external elements, thus making it difficult for the Region to exercise jurisdiction over the case;<\/span>
\n\uff08\u4e8c\uff09\u51fa\u73b0\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u65e0\u6cd5\u6709\u6548\u6267\u884c\u672c\u6cd5\u7684\u4e25\u91cd\u60c5\u51b5\u7684\uff1b<\/span>
\n(2) a serious situation occurs where the Government of the Region is unable to effectively enforce this Law; or<\/span>
\n\uff08\u4e09\uff09\u51fa\u73b0\u56fd\u5bb6\u5b89\u5168\u9762\u4e34\u91cd\u5927\u73b0\u5b9e\u5a01\u80c1\u7684\u60c5\u51b5\u7684\u3002<\/span>
\n(3) a major and imminent threat to national security has occurred.<\/span>
\n\u7b2c\u4e94\u5341\u516d\u6761\u3000\u6839\u636e\u672c\u6cd5\u7b2c\u4e94\u5341\u4e94\u6761\u89c4\u5b9a\u7ba1\u8f96\u6709\u5173\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u65f6\uff0c\u7531\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u8d1f\u8d23\u7acb\u6848\u4fa6\u67e5\uff0c\u6700\u9ad8\u4eba\u6c11\u68c0\u5bdf\u9662\u6307\u5b9a\u6709\u5173\u68c0\u5bdf\u673a\u5173\u884c\u4f7f\u68c0\u5bdf\u6743\uff0c\u6700\u9ad8\u4eba\u6c11\u6cd5\u9662\u6307\u5b9a\u6709\u5173\u6cd5\u9662\u884c\u4f7f\u5ba1\u5224\u6743\u3002<\/span>
\nArticle 56 In exercising jurisdiction over a case concerning offence endangering national security pursuant to Article 55 of this Law, the Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region shall initiate investigation into the case, the Supreme People\u2019s Procuratorate shall designate a prosecuting body to prosecute it, and the Supreme People\u2019s Court shall designate a court to adjudicate it.<\/span>
\n\u7b2c\u4e94\u5341\u4e03\u6761\u3000\u6839\u636e\u672c\u6cd5\u7b2c\u4e94\u5341\u4e94\u6761\u89c4\u5b9a\u7ba1\u8f96\u6848\u4ef6\u7684\u7acb\u6848\u4fa6\u67e5\u3001\u5ba1\u67e5\u8d77\u8bc9\u3001\u5ba1\u5224\u548c\u5211\u7f5a\u7684\u6267\u884c\u7b49\u8bc9\u8bbc\u7a0b\u5e8f\u4e8b\u5b9c\uff0c\u9002\u7528\u300a\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u5211\u4e8b\u8bc9\u8bbc\u6cd5\u300b\u7b49\u76f8\u5173\u6cd5\u5f8b\u7684\u89c4\u5b9a\u3002<\/span>
\nArticle 57 The Criminal Procedure Law of the People\u2019s Republic of China and other related national laws shall apply to procedural matters, including those related to criminal investigation, examination and prosecution, trial, and execution of penalty, in respect of cases over which jurisdiction is exercised pursuant to Article 55 of this Law.<\/span>
\n\u6839\u636e\u672c\u6cd5\u7b2c\u4e94\u5341\u4e94\u6761\u89c4\u5b9a\u7ba1\u8f96\u6848\u4ef6\u65f6\uff0c\u672c\u6cd5\u7b2c\u4e94\u5341\u516d\u6761\u89c4\u5b9a\u7684\u6267\u6cd5\u3001\u53f8\u6cd5\u673a\u5173\u4f9d\u6cd5\u884c\u4f7f\u76f8\u5173\u6743\u529b\uff0c\u5176\u4e3a\u51b3\u5b9a\u91c7\u53d6\u5f3a\u5236\u63aa\u65bd\u3001\u4fa6\u67e5\u63aa\u65bd\u548c\u53f8\u6cd5\u88c1\u5224\u800c\u7b7e\u53d1\u7684\u6cd5\u5f8b\u6587\u4e66\u5728\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u5177\u6709\u6cd5\u5f8b\u6548\u529b\u3002\u5bf9\u4e8e\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u4f9d\u6cd5\u91c7\u53d6\u7684\u63aa\u65bd\uff0c\u6709\u5173\u673a\u6784\u3001\u7ec4\u7ec7\u548c\u4e2a\u4eba\u5fc5\u987b\u9075\u4ece\u3002<\/span>
\nWhen exercising jurisdiction over cases pursuant to Article 55 of this Law, the law enforcement and judicial authorities referred to in Article 56 of this Law shall exercise powers in accordance with the law. The legal documents issued by these authorities on their decisions to take mandatory and investigation measures and on their judicial decisions shall have legal force in the Hong Kong Special Administrative Region. The institutions, organisations and individuals concerned must comply with measures taken by the Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region in accordance with the law.<\/span>
\n\u7b2c\u4e94\u5341\u516b\u6761\u3000\u6839\u636e\u672c\u6cd5\u7b2c\u4e94\u5341\u4e94\u6761\u89c4\u5b9a\u7ba1\u8f96\u6848\u4ef6\u65f6\uff0c\u72af\u7f6a\u5acc\u7591\u4eba\u81ea\u88ab\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u7b2c\u4e00\u6b21\u8baf\u95ee\u6216\u8005\u91c7\u53d6\u5f3a\u5236\u63aa\u65bd\u4e4b\u65e5\u8d77\uff0c\u6709\u6743\u59d4\u6258\u5f8b\u5e08\u4f5c\u4e3a\u8fa9\u62a4\u4eba\u3002\u8fa9\u62a4\u5f8b\u5e08\u53ef\u4ee5\u4f9d\u6cd5\u4e3a\u72af\u7f6a\u5acc\u7591\u4eba\u3001\u88ab\u544a\u4eba\u63d0\u4f9b\u6cd5\u5f8b\u5e2e\u52a9\u3002<\/span>
\nArticle 58 In a case over which jurisdiction is exercised pursuant to Article 55 of this Law, a criminal suspect shall have the right to retain a lawyer to represent him or her from the day he or she first receives inquiry made by the Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region or from the day a mandatory measure is taken against him or her. A defence lawyer may provide legal assistance to a criminal suspect or defendant in accordance with the law.<\/span>
\n\u72af\u7f6a\u5acc\u7591\u4eba\u3001\u88ab\u544a\u4eba\u88ab\u5408\u6cd5\u62d8\u6355\u540e\uff0c\u4eab\u6709\u5c3d\u65e9\u63a5\u53d7\u53f8\u6cd5\u673a\u5173\u516c\u6b63\u5ba1\u5224\u7684\u6743\u5229\u3002<\/span>
\nA criminal suspect or defendant who is arrested in accordance with the law shall be entitled to a fair trial before a judicial body without undue delay.<\/span>
\n\u7b2c\u4e94\u5341\u4e5d\u6761\u3000\u6839\u636e\u672c\u6cd5\u7b2c\u4e94\u5341\u4e94\u6761\u89c4\u5b9a\u7ba1\u8f96\u6848\u4ef6\u65f6\uff0c\u4efb\u4f55\u4eba\u5982\u679c\u77e5\u9053\u672c\u6cd5\u89c4\u5b9a\u7684\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u60c5\u51b5\uff0c\u90fd\u6709\u5982\u5b9e\u4f5c\u8bc1\u7684\u4e49\u52a1\u3002<\/span>
\nArticle 59 In a case over which jurisdiction is exercised pursuant to Article 55 of this Law, any person who has information pertaining to an offence endangering national security under this Law is obliged to testify truthfully.<\/span>
\n\u7b2c\u516d\u5341\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u53ca\u5176\u4eba\u5458\u4f9d\u636e\u672c\u6cd5\u6267\u884c\u804c\u52a1\u7684\u884c\u4e3a\uff0c\u4e0d\u53d7\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ba1\u8f96\u3002<\/span>
\nArticle 60 The acts performed in the course of duty by the Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region and its staff in accordance with this Law shall not be subject to the jurisdiction of the Hong Kong Special Administrative Region.<\/span>
\n\u6301\u6709\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u5236\u53d1\u7684\u8bc1\u4ef6\u6216\u8005\u8bc1\u660e\u6587\u4ef6\u7684\u4eba\u5458\u548c\u8f66\u8f86\u7b49\u5728\u6267\u884c\u804c\u52a1\u65f6\u4e0d\u53d7\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6267\u6cd5\u4eba\u5458\u68c0\u67e5\u3001\u641c\u67e5\u548c\u6263\u62bc\u3002<\/span>
\nIn the course of performing duty, a holder of an identification document or a document of certification issued by the Office and the articles including vehicles used by the holder shall not be subject to inspection, search or detention by law enforcement officers of the Region.<\/span>
\n\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u53ca\u5176\u4eba\u5458\u4eab\u6709\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6cd5\u5f8b\u89c4\u5b9a\u7684\u5176\u4ed6\u6743\u5229\u548c\u8c41\u514d\u3002<\/span>
\nThe Office and its staff shall enjoy other rights and immunities provided by laws of the Region.<\/span>
\n\u7b2c\u516d\u5341\u4e00\u6761\u3000\u9a7b\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u7ef4\u62a4\u56fd\u5bb6\u5b89\u5168\u516c\u7f72\u4f9d\u636e\u672c\u6cd5\u89c4\u5b9a\u5c65\u884c\u804c\u8d23\u65f6\uff0c\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u653f\u5e9c\u6709\u5173\u90e8\u95e8\u987b\u63d0\u4f9b\u5fc5\u8981\u7684\u4fbf\u5229\u548c\u914d\u5408\uff0c\u5bf9\u59a8\u788d\u6709\u5173\u6267\u884c\u804c\u52a1\u7684\u884c\u4e3a\u4f9d\u6cd5\u4e88\u4ee5\u5236\u6b62\u5e76\u8ffd\u7a76\u8d23\u4efb\u3002<\/span>
\nArticle 61 The relevant departments of the Government of the Hong Kong Special Administrative Region shall provide necessary facilitation and support to the Office for Safeguarding National Security of the Central People\u2019s Government in the Hong Kong Special Administrative Region in performing its mandate in accordance with this Law, and shall stop any act obstructing the performance of such mandate and hold those who commit such act liable in accordance with the law.<\/span>
\n\u7b2c\u516d\u7ae0\u3000\u9644\u5219<\/span>
\nChapter VI Supplementary Provisions<\/span>
\n\u7b2c\u516d\u5341\u4e8c\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u672c\u5730\u6cd5\u5f8b\u89c4\u5b9a\u4e0e\u672c\u6cd5\u4e0d\u4e00\u81f4\u7684\uff0c\u9002\u7528\u672c\u6cd5\u89c4\u5b9a\u3002<\/span>
\nArticle 62 This Law shall prevail where provisions of the local laws of the Hong Kong Special Administrative Region are inconsistent with this Law.<\/span>
\n\u7b2c\u516d\u5341\u4e09\u6761\u3000\u529e\u7406\u672c\u6cd5\u89c4\u5b9a\u7684\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u7684\u6709\u5173\u6267\u6cd5\u3001\u53f8\u6cd5\u673a\u5173\u53ca\u5176\u4eba\u5458\u6216\u8005\u529e\u7406\u5176\u4ed6\u5371\u5bb3\u56fd\u5bb6\u5b89\u5168\u72af\u7f6a\u6848\u4ef6\u7684\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u6267\u6cd5\u3001\u53f8\u6cd5\u673a\u5173\u53ca\u5176\u4eba\u5458\uff0c\u5e94\u5f53\u5bf9\u529e\u6848\u8fc7\u7a0b\u4e2d\u77e5\u6089\u7684\u56fd\u5bb6\u79d8\u5bc6\u3001\u5546\u4e1a\u79d8\u5bc6\u548c\u4e2a\u4eba\u9690\u79c1\u4e88\u4ee5\u4fdd\u5bc6\u3002<\/span>
\nArticle 63 The law enforcement and judicial authorities and their staff who handle cases concerning offence endangering national security under this Law, or the law enforcement and judicial authorities of the Hong Kong Special Administrative Region and their staff who handle other cases concerning offence endangering national security, shall keep confidential State secrets, trade secrets or personal information which they come to know in the process of handling such cases.<\/span>
\n\u62c5\u4efb\u8fa9\u62a4\u4eba\u6216\u8005\u8bc9\u8bbc\u4ee3\u7406\u4eba\u7684\u5f8b\u5e08\u5e94\u5f53\u4fdd\u5b88\u5728\u6267\u4e1a\u6d3b\u52a8\u4e2d\u77e5\u6089\u7684\u56fd\u5bb6\u79d8\u5bc6\u3001\u5546\u4e1a\u79d8\u5bc6\u548c\u4e2a\u4eba\u9690\u79c1\u3002<\/span>
\nA lawyer who serves as defence counsel or legal representative shall keep confidential State secrets, trade secrets or personal information which he or she comes to know in the practice of law.<\/span>
\n\u914d\u5408\u529e\u6848\u7684\u6709\u5173\u673a\u6784\u3001\u7ec4\u7ec7\u548c\u4e2a\u4eba\u5e94\u5f53\u5bf9\u6848\u4ef6\u6709\u5173\u60c5\u51b5\u4e88\u4ee5\u4fdd\u5bc6\u3002<\/span>
\nThe relevant institutions, organisations and individuals who assist with the handling of a case shall keep confidential any information pertaining to the case.<\/span>
\n\u7b2c\u516d\u5341\u56db\u6761\u3000\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u9002\u7528\u672c\u6cd5\u65f6\uff0c\u672c\u6cd5\u89c4\u5b9a\u7684\u201c\u6709\u671f\u5f92\u5211\u201d\u201c\u65e0\u671f\u5f92\u5211\u201d\u201c\u6ca1\u6536\u8d22\u4ea7\u201d\u548c\u201c\u7f5a\u91d1\u201d\u5206\u522b\u6307\u201c\u76d1\u7981\u201d\u201c\u7ec8\u8eab\u76d1\u7981\u201d\u201c\u5145\u516c\u72af\u7f6a\u6240\u5f97\u201d\u548c\u201c\u7f5a\u6b3e\u201d\uff0c\u201c\u62d8\u5f79\u201d\u53c2\u7167\u9002\u7528\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u76f8\u5173\u6cd5\u5f8b\u89c4\u5b9a\u7684\u201c\u76d1\u7981\u201d\u201c\u5165\u52b3\u5f79\u4e2d\u5fc3\u201d\u201c\u5165\u6559\u5bfc\u6240\u201d\uff0c\u201c\u7ba1\u5236\u201d\u53c2\u7167\u9002\u7528\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u76f8\u5173\u6cd5\u5f8b\u89c4\u5b9a\u7684\u201c\u793e\u4f1a\u670d\u52a1\u4ee4\u201d\u201c\u5165\u611f\u5316\u9662\u201d\uff0c\u201c\u540a\u9500\u6267\u7167\u6216\u8005\u8425\u4e1a\u8bb8\u53ef\u8bc1\u201d\u6307\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u76f8\u5173\u6cd5\u5f8b\u89c4\u5b9a\u7684\u201c\u53d6\u6d88\u6ce8\u518c\u6216\u8005\u6ce8\u518c\u8c41\u514d\uff0c\u6216\u8005\u53d6\u6d88\u724c\u7167\u201d\u3002<\/span>
\nArticle 64 In the application of this Law in the Hong Kong Special Administrative Region, the terms \u201cfixed-term imprisonment\u201d, \u201clife imprisonment\u201d, \u201cconfiscation of property\u201d and \u201ccriminal fine\u201d in this Law respectively mean \u201cimprisonment\u201d, \u201cimprisonment for life\u201d, \u201cconfiscation of proceeds of crime\u201d and \u201cfine\u201d; \u201cshort-term detention\u201d shall be construed, with reference to the relevant laws of the Region, as \u201cimprisonment\u201d, \u201cdetention in a detention centre\u201d or \u201cdetention in a training centre\u201d; \u201crestriction\u201d shall be construed, with reference to the relevant laws of the Region, as \u201ccommunity service\u201d or \u201cdetention in a reformatory school\u201d; and \u201crevoke licence or business permit\u201d means \u201crevoke registration or exemption from registration, or revoke licence\u201d as provided for in the relevant laws of the Region.<\/span>
\n\u7b2c\u516d\u5341\u4e94\u6761\u3000\u672c\u6cd5\u7684\u89e3\u91ca\u6743\u5c5e\u4e8e\u5168\u56fd\u4eba\u6c11\u4ee3\u8868\u5927\u4f1a\u5e38\u52a1\u59d4\u5458\u4f1a\u3002<\/span>
\nArticle 65 The power of interpretation of this Law shall be vested in the Standing Committee of the National People\u2019s Congress.<\/span>
\n\u7b2c\u516d\u5341\u516d\u6761\u3000\u672c\u6cd5\u81ea\u516c\u5e03\u4e4b\u65e5\u8d77\u65bd\u884c\u3002<\/span>
\nArticle 66 This Law shall come into force on the date of its promulgation.<\/span>\n\t<\/p>\n
